Eyewitness identification speed: Slow identifications from highly confident eyewitnesses hurt perceptions of their testimony.

Abstract: How persuasive is eyewitness confidence? Are highly confident eyewitnesses so persuasive that their testimony overshadows other countervailing evidence? To answer these questions, participants evaluated a highly confident eyewitness's lineup identification. Participants learned that an eyewitness either quickly identified the suspect (e.g., "I'm sure it's him. I identified him instantly."), slowly identified the suspect (e.g., "I'm sure it's him. I identified him after a while.") or they learned nothing about … Show more

“…Consequently, individuals also rate the eyewitnesses as less accurate in their identification, and judge the suspect as less likely to be guilty, when eyewitnesses provide featural statements. Another factor that affects how individuals view eyewitness confidence is identification speed (Dodson et al, 2021). Mock jurors rate eyewitnesses who express high confidence in an identification as less accurate, and the suspect as less likely to be guilty, if the eyewitness states that they made the identification “after a while” rather than “instantly.” Further studies on eyewitness testimony variables that moderate perceptions of eyewitness confidence and corresponding judgments of eyewitness accuracy and defendant guilt would aid our understanding of how individuals make judgments regarding eyewitness confidence.…”

“…Hence, it may be difficult for the legal system to determine a precise cutoff for what constitutes a high level of verbal confidence. Moreover, research suggests that contextual information, such as eyewitnesses’ justifications for their identification decisions (e.g., Dodson & Dobolyi, 2015), information about whether the eyewitness picked the suspect or a filler (Grabman & Dodson, 2019), and information about the speed of the eyewitness’s identification decision (Dodson et al, in press) can influence interpretations of eyewitnesses’ verbal confidence statements, further complicating legal determinations of what constitutes a high-verbal-confidence identification.…”

“…Reflector variables refer to behaviors emitted by an eyewitness during an identification procedure that covary with (or reflect) accuracy (Quigley-McBride & Wells, 2023; Smith & Wells, 2023; Wells, 2020). Laypersons perceive high-confidence suspect identifications as more likely to be accurate than low-confidence suspect identifications and fast suspect identifications as more likely to be accurate than slow suspect identifications (Dodson et al, 2021; Garrett et al, 2020, Slane & Dodson, 2022). In fact, laypersons will even discount a high-confidence suspect identification if it took the witness a long time to make that identification decision (Dodson et al, 2021).…”
