Turkish law requires transfer of the possession of the motor vehicle under a notarial deed with the owner for the transfer of ownership of the vehicle which is registered under the traffic registry. This includes the requirement of conclusion of the contract with a person having the right of disposition. Where a person not having the right of disposition is registered as the owner in the traffic registry, good faith acquisition of a third party from that person cannot be protected. Because neither traffic registry is given a publicity function nor Turkish law includes any provision that protects good faith in traffic registry. In this regard the party whose good faith is not protected can ask the owner for the payment of the amount which is paid by herself to the unauthorized possessor for the motor vehicle, under Article 989 paragraph 2 of the Turkish Civil Code. The scope of the obligation of the unauthorized possessor to return the motor vehicle and his possible claims arising from his costs for the vehicle are subject to Articles 993-995 of the Turkish Civil Code.
