An ouster clause is a specific provision designed to exclude the courts' jurisdiction over certain matters. It aims to prevent courts from reviewing decisions made by public functionaries. As the roles and functions of public functionaries expand in a welfare state, the implementation and interpretation of ouster clauses become increasingly intricate. For an ouster clause to be effective, the intention to exclude judicial oversight must be either explicitly stated or clearly implied within the statute. Yet, the idea of a total exclusion from judicial review, especially concerning administrative actions, is widely considered unattainable. Superior courts consistently assert that absolute ouster is an alien concept in jurisprudence. In contemporary times, review of numerous judicial precedents shows that they have developed their own principles to address ouster clauses, and though they exhibit variations, but they present similar reasonings in their objective of governing, limiting, or permitting the use of ouster clauses. In this research, an attempt will be made to delve into an examination and present an overview of the principles established by the courts in England, India, and those expounded by the superior courts in Pakistan regarding ouster clauses.

Self-assessment with corrective training has been long seen crucial in helping learners improve their own work. This study investigates a group of 28 Englishmajored students' self-assessment of their Speaking performance at the end of a Speaking course at a university. First, the study explores their knowledge of the speaking test and then it provides them with 11 meetings of training on and practising using a speaking rubric which centres on the four grading criteria: Fluency and coherence, Pronunciation, Grammatical range, and Lexical resources. The participants' perception about their speaking performance after they took the speaking test is also explored. Finally, two examiners are employed to rate these students' speaking performance. The results revealed that the participants were found to be knowledgeable about the requirements in doing the test. Then, for their self-assessment on their test performance, they used the trained rubric to help them rate their work quite well, which highly correlated with the result of the teachers' rating which was also correlated with the average score of the two raters. The students' perceptions about their ability to perform these four Speaking grading criteria after taking the test also unveiled a strong connection to their overall selfassessment result.

Contributions and controversies of self-assessment to the development of writing skill

The current study investigated how self–assessment activity contributes to the development of EFL student writing skills. This study used qualitative and quantitative approaches to explore how in-service students develop their writing skill through this assessment. A total of 120 third-year students registered for taking writing course were purposively sampled. Pre and post intervention questionnaires were used to collect data from the all 120 subjects and focus group discussions were conducted with 10 subjects. Observation during the self-assessment activities was also among the tools used to collect data. The findings show that in-service students’ writing proficiencies can be improved through self-assessment activities. However, factors, including students’ awareness, their past practices and the difficulties related to the nature of writing can influence negatively on their performance.
