In labor law, although it has recently increased due to the coronavirus epidemic, home-based work is a working model that has existed for many years.Especially due to the widespread use of technological communication tools and the digital age we live in, it has become easier to conduct business at home. Indeed, in addition to the fact that the principles of time and space are disappearing at this stage, in accordance with the nature of the work contract, the employee will be able to work from home. However, since the model of home-based work changes according to the sector, then the efficiency obtained from home-based work will also differ to this extent.The Turkish Code of Obligations 461-469 has regulated contract of service at home and the ILO (International Labour Organization) has regulated home-based work. Thus, by regulating telework in the Labour Code number 4857, home-based work can be considered a subtitle of this topic. Performing work from home, not the workplace, has become inevitable for continued production with the effect of the coronavirus epidemic that has affected the entire world. For this reason, it is very important to examine the issue of working from home and to determine the terms of the employment contract accordingly.In this study, first the work at home will be studied in general. Then, the types of work at home and the various rights and obligations of the employee and the employer arising from the employment contract cases of work from home will be examined.
