Mandatory Pre-Judicial Settlement of Disputes and Implementation of the Right to Legal Protection: Features of the Legislative Regulation

Abstract

the entry into force of the Law of Ukraine «On Amending the Constitution of Ukraine (Regarding Justice)» dated 02.06.2016 № 1401-VIII in the norms of the Constitution of Ukraine, provisions appeared that, in our opinion, are contradictory and, accordingly, create such conditions under which the standards of realization of a person's right to legal protection are reduced. Proposed changes to the current legislation, with the aim of developing the practice of pretrial settlement of disputes, taking into account the fact that such practice should not be an obstacle to the realization of a person's right to judicial protection.
