Mapping the Patent Landscape of Quantum Technologies: Patenting Trends, Innovation and Policy Implications

Abstract: Recent technical breakthroughs underscore the potential of second generation (2G) quantum technologies including quantum simulation, quantum sensing and metrology, quantum computation, and quantum communication. Patenting trends of such technologies are an indicator of the pace of innovation at the invention stage. Empirical studies looking at the real-world patenting activity can provide valuable evidence to help assess and guide policy proposals related to intellectual property rights (IPRs), innovation and … Show more

“…Attributing legal designations to these overlapping technologies and synergies will be a challenge, e.g., in quantum-AI hybrids, or nano-scale classical computing below 10 nm, in which quantum mechanical effects such as tunneling and energy quantization become unavoidable (Kop, 2021f ). In this light, lawmakers should not hesitate to experiment with demarcating legal fields such as the Law of Quantum, and legal definitions such as the material scope of a quantum patent, to prevent codified law from falling too far behind the daily practice of technological advancements, which are taking place at an exponential pace (Aboy et al, 2022 ).…”

“…As we stand on the cusp of the second quantum revolution, we face unprecedented opportunities and challenges in the field of quantum technology (QT) [1]. A recent empirical landscape study showed an exponential increase in the number of patents directed to QT inventions, illustrating the sheer pace and breadth of quantum innovation [2]. With the potential to revolutionize computation, cybersecurity, communication and sensing, QT and its anticipated future uses are poised to redefine the way we understand and interact with the world.…”
