Perlindungan Hukum Desain Kerajinan Baju Barong Bali Sebagai Desain Tradisional

Abstract

Industrial design law in protecting traditional design especially barong design on Balinese barong clothes has not been regulated in act number 31 of 2004 on industrial design. This shows that there is a norm void. The purpose of this research are to find out the regulation of Industrial design law in protecting Balinese barong dress craft design as a traditional design and to find out the legal protection effort in protecting Balinese barong dress craft design as a traditional design. This research is using normative legal research method. The results shows that although Balinese barong is included in Traditional Cultural Expressions whose regulated by copyright, but the copyright not precise to protect traditional designs in the industry coverage therefore it is regulated by the Industrial Design Law. Preventive legal protection can be done by revising the Industrial Design Law and providing socialization, whereas repressive legal protection can be completed through the judiciary and dispute resolution outside the court. The conclusion of this research is that the Industrial Design Law has not been able to protect Balinese barong clothes as a traditional design and the form of legal protection that can be done is through preventive and repressive legal protection effort.Keywords: legal protection; traditional design.Abstrak Pengaturan hukum desain industri dalam melindungi desain tradisional khususnya desain barong pada baju barong Bali belum diatur dalam UU Nomor 31 Tahun 2004 tentang Desain Industri. Hal ini menunjukkan adanya kekosongan norma pada UU Desain Industri. Adapun tujuan penulisan penelitian ini antara lain untuk mengetahui pengaturan hukum desain industri dalam melindungi desain kerajinan baju barong bali sebagai desain tradisional dan untuk mengetahui upaya perlindungan hukum dalam melindungi desain kerajinan baju barong Bali sebagai desain tradisional. Metode penelitian yang digunakan dalam penulisan ini adalah metode penelitian hukum yuridis normatif. Hasil penelitian menunjukkan bahwa meskipun barong Bali termasuk dalam Ekspresi Budaya Tradisional yang pengaturannya diatur dengan hak cipta, tapi UU Hak Cipta dikatakan belum tepat untuk melindungi desain tradisional dalam lingkup industri oleh karena itu hal ini diatur dengan UU Desain Industri. Upaya perlindungan hukum preventif dapat dilakukan dengan direvisinya UU Desain Industri dan pemberian sosialisasi terhadap masyarakat, sedangkan upaya perlindungan hukum represif dapat diselesaikan melalui badan peradilan dan penyelesaian sengketa di luar pengadilan. Simpulan dari penelitian ini adalah UU Desain Industri belum mampu melindungi baju barong Bali sebagai desain tradisional dan adapun bentuk upaya perlindungan hukum yang dapat dilakukan adalah melalui upaya perlindungan hukum preventif dan represif.Kata kunci: perlindungan hukum; desain tradisional.
