Abstract

ARTiClE 10 -PROMOTiON, PROTECTiON AND TREATMENT OF iNVESTMENTS commentary surveys relevant decisions of the aforementioned ECT arbitral tribunals and discusses, where apposite, selected decisions of other arbitral tribunals.There is a vast body of scholarly literature which has analysed, with varying degrees of depth, Article 10 and, in general, Part III. 9 This body of literature has also been comprehensively surveyed in this commentary.This commentary provides an overview and analysis of Part III and Article 10 on the basis of the aforementioned bodies of decisions of arbitral tribunals and scholarly literature.
