§ 370 para. 4 sentence 3 of the German Fiscal Code (AO) is a highly controversial provision in terms of its purpose and scope of application. It is increasingly subject to constitutional criticism. The thesis shows to what extent the so-called prohibition of compensation rule (Kompensationsverbot) is still justified today. For this purpose, fundamental questions of tax evasion are examined and the case law on § 370 para. 4 sentence 3 AO is systematised and critically reviewed. Based on these findings, the paper identifies legal criteria for the applicability of the regulation and addresses the question of whether and when it also has effects beyond the scope of tax evasion. In the final part of the thesis, problems with respect to § 370 para. 4 sentence 3 AO arising from the new regulations on voluntary disclosure are examined. The work adresses scholars and practitioners of business and tax criminal law.

The rapid development and wide commercial implementation of automotive radar sensors are strengthening the already considerable interest in matching radar target simulators. Such simulators boast promising results when used for both essential functional inspections of active sensors and the high-speed testing of numerous traffic scenarios while examining complex reactions of automobile electronic systems. For these purposes, advanced versions of target simulators enabling a generation of multiple targets moving at different velocities and ranges are required. The design, practical implementation and system programming of advanced sensor simulator setups require a detailed analytical description concerning all important technical aspects. An abundance of detailed information on the behavior and parameters of automotive radar sensors can be found in the references, but similar knowledge on sensor simulator setups is lacking. This article presents detailed analyses of the all-important RF parameters, where special attention is paid to phase noise, and its analytical description takes into account an even greater number of simulated targets. The derived analytical formulas enable both an optimal setup implementation and system programming of a wide range of practical testing procedures.

Abstract. Increased complexity and severity of future driver assistance systems demand extensive testing and validation. As supplement to road tests, driving simulations offer various benefits. For driver assistance functions the perception of the sensors is crucial. Therefore, sensors also have to be modeled. In this contribution, a statistical data-driven sensormodel, is described. The state-space based method is capable of modeling various types behavior. In this contribution, the modeling of the position estimation of an automotive radar system, including autocorrelations, is presented. For rendering real-time capability, an efficient implementation is presented.
