RETRACTED: Analysis of the Legal Framework Governing Gas Flaring in Nigeria’s Upstream Petroleum Sector and the Need for Overhauling

Abstract: Nigeria is rated the number one producer of crude oil in Africa. Still, oil exploration activities have resulted in a high rate of gas flaring due to weak enforcement of the anti-gas flaring laws by the regulatory authorities. Associated natural gas is generated from oil production, and it is burnt in large volumes, thereby leading to the emission of greenhouse gases and waste of natural resources which could have generated billions of dollars for the Federal Government of Nigeria. There are concerns that if n… Show more

“…This prompted the need to promote investment in renewable energy sources through private and public partnerships to promote access to electricity in all nooks and crannies in Nigeria. However, despite legal enactments guiding the operations of the Nigeria power sector, the challenge of sufficient power generation and the guarantee for reliable power supply has remained critical that has called for continuous attention, which justifies the effort put in the current research (Olujobi 2020b).…”

“…On the issue of gas flaring, there have been several legal regimes that appear unenforceable. These are: (1) The Gas Flaring (Prohibition and Punishment) Act, 2009, with a gas flaring time limit fixed for 31 st December, 2010; (ii) The Petroleum Industry Bill has set a gas flaring deadline for 2012; (iii) The Gas Flaring Prohibition and Punishment Bill, 2016, set the time limit for gas flaring to December, 2016;(iv) The new Petroleum Industry Governance Bill, 2017, outlawed gas flaring; and (v) The Gas and Associated Gas Re-injection (Amendment Bill) that is pending in the National Assembly (Olujobi, 2020). Lack of political will coupled with the inability of government to divorce vested interests from the governance of downstream sector of the petroleum industry partly account for these ineffectual legal regimes.…”

“…Carbon emission from gas flaring in the Nigerian oil and gas sector may be described as a direct indicator of vulnerability at sector level. Gas flaring represents burning of an important energy resource leading to loss of significant amount of revenue and resulting in carbon emission (Akinola, 2018; Olujobi, 2020). This study suspects that as a source of vulnerability, flaring of ANG leading to emission of carbon dioxide may hurt the Nigerian GDP.…”

“…Of course, the government realised this a long time ago and has been putting measures in place in the form of policies and regulations to end the practice. Regrettably, however, gas flaring described as environmentally damaging and financially wasteful (Akinola, 2018; Olujobi, 2020) still persists in Nigeria. Consequently, the purpose of this paper is twofold.…”
