The Minimum Age of Criminal Responsibility: The Need for a Holistic Approach

Abstract: The minimum age of criminal responsibility in England and Wales remains 10 years: something which has attracted criticism globally by policy makers and youth justice practitioners. Many countries, including Belgium, Ireland, Netherlands (Brown & Charles, 2021) and Scotland (Age of Criminal Responsibility (Scotland) Act 2019) have their MACR set at twelve years. Furthermore, Article 17.1 of the Beijing Rules recognised that in dealing with juvenile offenders, apart from the needs of the juvenile, the authorities could also take into account the gravity of the offence and the needs of society.…”
