The privatization of neighborhood governance and the production of urban space

Abstract: A pivotal innovation in the production of urban space has been the rise of privately governed neighborhoods overseen by homeowners associations (HOAs). One in every five American households resides in an HOA neighborhood regulated by conditions, covenants, and restrictions amounting to what has been referred to as a ''quiet revolution'' of urban politics. Their proliferation across cities warrants greater attention as they signify the transformation of state-civil society relations whereby nonstate entities ar… Show more

“…Boone et al [86] noted that vegetation in newly built suburbs is more likely to be the perception of what the developer believes will satisfy buyers, rather than an expression of the neighborhood or residents preferences. However, to subdivide land and to obtain building permits, residential developers must also comply with the local planning regulations [41,43,46]. Some of these directly affect the vegetation composition or structure.…”

“…The landscaping is typically one of the last steps, along with other presale work [42]. Depending on the location, municipalities and/or homeowners associations may specifically regulate aesthetics, planting plans, tree removal, and maintenance for subdivisions and for yards [43-46]. After the new homeowners move in, they may or not update or change the initial yard configuration, remove plants, and plant more or different species.…”

“…Indeed, research suggests normative lawn behaviors are often clustered at the neighborhood scale and homeowners' lawn management practices are associated with a greater connection to their community (Robbins, 2007). The appeal of social inclusion and belonging is strong enough that homeowners may at times be willing to overlook their own landscaping preferences, environmental concerns, or health in favor of conformity, particularly when it comes to more intensive lawn management norms, like chemical fertilizer application (Fraser, Bazuin, and Hornberger, 2015). Yet, lawn management norms are not simply tied to maintaining a consistent neighborhood aesthetic, or even a neighborhood culture; they are more broadly an expression of affluence, socio-economic status, and group identity (Robbins, 2007).…”

“…Although not the same as municipal laws, homeowners associations (HOAs) can enforce restrictive covenants that formalize otherwise informal lawn management norms. In these cases, the mere presence of HOA enforcement ability may strengthen and perpetuate lawn care norms in a given neighborhood (Fraser et al, 2013;Fraser et al, 2015). As informal and formal rules, norms and laws both incentivize and punish human behavior working to complement, substitute, or preclude the other (McAdams, 1997;Posner, 1997).…”

“…Бэзуин и Дж. Хорнбергер [18] отмечают, что быстрое распространение в конце XX в. закрытых жилых райо-нов и сообществ, находящихся в ведении частных ассоциаций, является важным показателем ши-роких социальных трансформаций. Они перекраивают городской ландшафт в направлениях, кото-рые все больше привязывают судьбу местных жилищных рынков к глобальным волнам капитала.…”
