Feminist legal theory highlights the persistence of women's subordination within the prevailing legal framework and emphasizes the importance of legal mechanisms that promote women's emancipation and equality. So far, the discourse of feminist Islamic law in Indonesia has caused more rejection, particularly with the emergence of the Counter Legal Draf-Kompilasi Hukum Islam (CLD-KHI), which is considered contrary to Islamic law, one of which is in the provisions of 'iddah. This study seeks to examine and analyze the demand for gender equality in the 'iddah period as manifested in the CLD-KHI. Using a qualitative research approach emphasizing library-based research on the draft in question and the supporting writings, this study bases its content analysis on the theory of Maqāṣid al-Sharī'ah, with al-Shatibi as the primary source. The results of this study reveal an insufficiency in the justification of the plea for gender equality in the enforcement of 'iddah from the view of Maqāṣid al-Sharī'ah. From the conventional perspective of Islamic law, the principle of gender equality as a maqṣad does not have a solid foundation, so it leads to rejection rather than acceptance. Therefore, to bear fruit, any legislative effort in the field of Islamic law must be carefully shaped by methodologies and ethos derived primarily from its tradition.

The thick patriarchal culture legitimizes men to always be superior figures over women. If there are men and women, then men are required to be leaders, women are as followers only. The categorization is always based on sex, not skills, eligibility, and leadership capabilities. This patriarchal culture also affects the formation of households, where women are required to continue to obey their husbands even though the husband's policies intimidate them. If the wife resists, the wife is considered nushuz to her husband. According to classical scholars, a nushuz wife may even be beaten based on Surah An-Nisa' [4]:34. This verse must be reinterpreted so that it does not become legitimacy for men to commit arbitrariness or even domestic violence. Through maudhui interpretations which are also combined with Indonesian legislation, this library article was compiled to gain a more comprehensive and gender responsive understanding. The research was conducted by understanding asbabun nuzul, munasabah verses and contextualizing them with current conditions. This study found that the concept of nushuz does not legalize violence against wives. The beating of a wife who commits nushuz contained in An-Nisa '(4): 34 must be interpreted as an act to teach lessons, not to hurt or even commit violence. The wife's nushuz act against her husband so that the husband is allowed to beat her is when the wife commits 'fahisyah mubayyinah' namely zina, according to An-Nisa' (4): 19. Even the beating of a husband to his wife until she is injured can be declared as a husband's nushuz to his wife, because based on Al-Baqarah (2): 229 the husband can actually divorce her in a good way, no need to do violence to his wife.

Feminism, as a multifaceted movement and ideology, aims at achieving gender equality across various spheres including politics, economics, personal, and social realms. The persistent issues of inequality and injustice faced by women have led to the emergence of Islamic feminism as a response. This research employs a library research methodology, drawing from both classical and contemporary sources including books and articles discussing feminism and women's issues. The structural-functional approach is utilized as the theoretical framework, while an analytical descriptive method is employed for data analysis, focusing on elucidating the meaning, scope, and pertinent issues of discussion. Additionally, the comparative method is applied to examine the perspectives of various Muslim scholars. The findings reveal that Islam, predating the modern concept of feminism, addresses the rights and obligations of its adherents without discrimination, as outlined in the Qur'an. The intrinsic value of women in Islam is emphasized through virtues such as piety, chastity, and resilience in upholding beliefs. This paper contributes to the understanding of Islamic feminism and underscores the compatibility of feminist principles within an Islamic framework. AbstrakFeminisme, sebagai sebuah gerakan dan ideologi yang memiliki banyak perspektif, bertujuan untuk mencapai kesetaraan gender di berbagai bidang, termasuk politik, ekonomi, pribadi, dan sosial. Persoalan ketidaksetaraan dan ketidakadilan yang terus menerus dihadapi oleh perempuan telah mendorong munculnya feminisme Islam sebagai respon. Penelitian ini menggunakan metodologi penelitian kepustakaan, dengan mengambil sumber-sumber klasik dan kontemporer, termasuk buku-buku dan artikel-artikel yang membahas feminisme dan isu-isu perempuan. Pendekatan struktural-fungsional digunakan sebagai kerangka teori, sementara metode deskriptif analitis digunakan untuk analisis data, dengan fokus untuk menjelaskan makna, ruang lingkup, dan isu-isu yang berkaitan dengan pembahasan. Selain itu, metode komparatif juga digunakan untuk mengkaji perspektif dari berbagai cendekiawan Muslim. Temuan penelitian ini mengungkapkan bahwa Islam, yang mendahului konsep feminisme modern, membahas hak dan kewajiban pemeluknya tanpa diskriminasi, seperti yang diuraikan dalam Al-Qur'an. Nilai intrinsik perempuan dalam Islam ditekankan melalui kebajikan seperti kesalehan, kesucian, dan ketangguhan dalam menegakkan keyakinan. Makalah ini memberikan kontribusi terhadap pemahaman feminisme Islam dan menggarisbawahi kesesuaian prinsip-prinsip feminis dalam kerangka kerja Islam.
