Um modelo sofisticado de justiça

Abstract

Poverty is a condition that should be discussed not only from a socio-political point of view, but, also, legal. There are several historical rights, nowadays sculpted in the Brazilian Federal Constitution, destined to people in this condition. The criminal and criminal procedural law share many of them with the support of State initiatives as the structuring of offices for public defenders. However, despite the great textual advances of the laws, the daily routine during lawsuits and penitentiaries denounces a very different reality.Brazilian justice system encompasses a highly sophisticated structure, made up of countless courts, courts of first instance, sundry institutions and thousands of civil servants. As it is the case of all institutions, the Judiciary is in a constant process of reforms, prompted by the need to be updated so as to meet the huge and growing social demand for more and better services. Albeit sophisticated, the existing model does not satisfactorily meet the needs of the population; and that shows that the goals of social pacification it should aim will be achieved when the necessary structural, legislative and management reforms have been implemented.
