Violencia en la pareja: variables que inciden en el fenómeno de la retratación femenina / Partner’s violence: variables that influence the phenomenon of female withdrawal

Abstract

La presente investigación tuvo como objetivo analizar las variables asociadas al fenómeno de la retractación en delitos de violencia intrafamiliar en contexto de pareja. Se escogió este tema por encontrase escasamente estudiado y altamente presente, en delitos donde existe un vínculo afectivo entre el agresor y la víctima. Esta investigación contempló los pasos de una investigación cuantitativa. El estudio fue de tipo exploratorio y descriptivo. Para la recolección de los datos se utilizaron 60 carpetas investigativas de causas judiciales de mujeres que denunciaron violencia intrafamiliar por parte de sus parejas (30 con y 30 sin retractación), en las Fiscalías de Valparaíso y San Antonio. Se escogieron nueve variables, con el fin de analizar si éstas se relacionaban con la condición de retractación. Las variables seleccionadas fueron: instrucción educacional, experiencias de victimización, tiempo de la relación, gravedad de la violencia, dependencia económica, hijos menores de edad, apoyo al denunciar, medida adoptada por el tribunal y victimización secundaria. Se consideraron estas variables, basándose en la fundamentación teórica sobre violencia en la pareja y además, por ser éstas, razones frecuentemente aludidas tanto por las víctimas como por los profesionales tratantes, como causas de retractación. Con respecto a los resultados, no fue posible asociar ninguna de las variables con el fenómeno de la retractación, por lo que las conclusiones y sugerencias apuntaron a replantear la forma en cómo se ha entendido la retractación en el ámbito jurídico, con el fin de adecuar y mejorar el trabajo con las víctimas de violencia intrafamiliar. 
 Abstract: The present study aimed to analyze the variables associated with the retraction phenomenon in crimes of domestic violence in couples context. This theme was chosen because it has been scarcely studied and highly present in crimes where there is a bond between the perpetrator and the victim. This research contemplated the steps of a quantitative research. The study was exploratory and descriptive. The data was collected through the revision of 60 investigative folders of lawsuits by women who reported violence by their partners (30 with and 30 without retraction), in the Prosecution Office of Valparaiso and San Antonio. Nine variables were chosen with the aim of analyzing whether these related to the condition of retraction. The variables selected were: educational instruction, victimization experiences, length of the relationship, severity of violence, economic dependence, minor children, support in reporting, measures adopted by the court, and secondary victimization. These variables were considered, based on the theoretical foundation of partner violence and also because these reasons were often alluded by both victims and professional physicians as causes of retraction. With regard to the results, it was not possible to associate any of the variables with the phenomenon of retraction, so that the conclusions and suggestions are focused on rethinking the way retraction has been understood in the legal field, in order to adapt and improve the work with victims of domestic violence.
