Forum non conveniens is a mostly common law legal doctrine. According to this doctrine, if the international competent court, where the case is brought, determines that there is a court of another country that has closer and real contact with the case and is more suitable to hear the case, it may waive its international jurisdiction. There are provisions for the implementation of this doctrine in "Convention of 19 October 1996 on Jurisdiction, Applicable Law, Recognition, Enforcement and Co-operation in Respect of Parental Responsibility and Measures for the Protection of Children". These provisions are about the transfer of jurisdiction regulated in art. 8-9 and lis pendens regulated in art. 13(2). Although the doctrine of forum non conveniens is not accepted in Turkish Law, with the entry into force of the Convention in 2017, this doctrine will also have an impact on Turkish Law within the scope of the Convention.
