Abstract

The article reveals the essence of the concept of "consulting services in construction" and "engineering activities in construction". A comparative analysis of engineering and consulting services has been carried out. The normative legal acts on the issues of engineering and consulting services in construction have been analyzed. Introduced a new concept of "mixed services", which include engineering and consulting services in the field of construction, which will contribute to improving the system of public procurement and will take into account the level of professional competence and qualifications of professionals.It is proposed to determine and formalize by an act of the Government or the Ministry of Territories and Communities Development of Ukraine (Minregion) qualification requirements for participants in the procurement of engineering and consulting services, as well as to propose at the level of government regulation, in particular at the Minregion, to provide proposals for improving the standard form of public procurement methodology and draft sample contract forms in terms of "mixed services", in particular, interrelated engineering and consulting services in construction.Actualized the need to adapt the legislation in the field of public procurement in the provision of interrelated engineering and consulting services in construction.It was revealed that the main problem in procurement is an imperfection of the legal framework governing the procurement process in the implementation of mixed procurement, as underdeveloped at the level of legislative and bylaws issues to determine the codes of the Single Procurement Dictionary when providing technical supervision services with the partial involvement of engineer -consultant, not implemented at the level of bylaws methodology of tender documents, not developed standard forms of contracts when conducting so-called.
