The purpose of the study is to develop a mechanism for the formation of the competitive potential of the agricultural territories of Kazakhstan as the basis for ensuring the dynamic development of agricultural business in Kazakhstan. The research methodology is based on strategic alternative modeling for agricultural territories competitiveness management with the help of fuzzy cognitive logic. The study used a cognitive approach to decision making in the management of poorly structured systems proposed by V. Silov and actively developed in the works of modern scientists. Fifteen competent experts were invited to select the concepts and build a fuzzy cognitive map of the formation of the competitive potential of the agricultural territories of Kazakhstan. To carry out calculations and justify the content of the strategy, the authors used the software product "Intelligent generation of the best alternatives" ("IGLA"). The result of the study is the developed strategy for the management of agricultural territories competitiveness in Kazakhstan with a set of strategic goals and the best option for managerial impact, ensuring the formation of agricultural export potential of the region. The proposed version of the content of the strategy for managing the competitiveness of the agricultural territories of Kazakhstan can be used either as a system or as its separate elements in managing the development of agricultural business in the country and in developing strategic planning programs for the agro-industrial complex of the region. The novelty of the study in theoretical terms is justified by the approach to the formation of the country's agricultural export potential through ensuring the competitiveness of its agricultural territories. In methodological terms, the novelty of the study is expressed by the use of cognitive modeling technologies to develop a strategy for managing the competitiveness of Kazakhstan's agricultural territories, the implementation of which will allow achieving sustainable dynamics of agricultural production and increase the efficiency of the agricultural economy.
In this article, the authors compare alternative conflict resolution mechanisms in Colombia and Russia. In the former, conciliation is the most developed alternative dispute resolution mechanism, while in the latter, mediation is the most developed. In order to deepen this comparison, a qualitative research of interpretative nature has been developed with the support of bibliographic-documentary material. The main conclusion is that access to justice is a human right that has been positivized as a fundamental right in the constitutions of both Colombia and Russia. However, the Colombian Constitution allows individuals to exercise their jurisdictional functions on a temporary basis, unlike the Russian Constitution, which only authorizes judges from the Federation to exercise their jurisdictional functions. While conciliation in Colombia is developed and implemented through State-supervised Conciliation and Arbitration Centers, mediation in Russia is in its initial phase and has gradually gained acceptance in society. In both states, the implementation of alternative dispute resolution mechanisms has been driven by the need to decongest the courts and tribunals of ordinary justice. Therefore, it is useful to insist on the massive use of these instruments to make possible a justice that comes from the parties in conflict, that can repair the relations of the subjects in dispute and that tends towards the construction of more peaceful societies.
El objeto del artículo consiste en analizar la efectividad de la función de concreción de la obligación alimentaria que poseen los defensores de familia en el departamento del Atlántico y en ciudad de Barranquilla entre los años 2015 y 2017. La metodología empleada es la revisión documental, bibliográfica y el análisis crítico, mediante la cual se examina la data que permite establecer la efectividad de la concreción de la obligación alimentaria por parte de los defensores de familia adscritos al Instituto Colombiano del Bienestar Familiar. Se concluye principalmente que existe baja participación en el departamento del Atlántico y en la ciudad de Barranquilla en audiencias de conciliación en materia de alimentos respecto a la media del país por lo que se sugiere un mayor esfuerzo para incentivar el uso de los centros zonales de los municipios que procuran la resolución de conflictos en materia de alimentos.
