Statutorily, South Africa recognizes two school systems: the public and the independent schools. While the government controls the public schools, the independent schools are privately managed (Prinsloo 2005). Constitutionally, the right to education is entrenched in section 29 (1) of the Constitution of the Republic of South Africa. Individuals reserve the right (a) to primary education; this involves adult basic education as well as (b) studying further, and this becomes the sole responsibility of the state visa -vis equitable evaluation that is made progressively accessible (Mamogale 2016). Reckoning with the International Law on Basic Education, countries world over needed to guide the right of individuals to basic education immediately at the World Declaration on Education for All (UNESCO, World declaration on education for all and framework for action to meet basic learning needs.
