The mass media is an essential support for the criminal policy, namely providing the role of crime prevention. Whilst penal policy is still available as solution, prevention through mass media is highly recommended because penal policies should not employed as the only way of suppressing crime. Nevertheless, the mass media must carries the values of Pancasila as the fundamental way of life of each Indonesian citizen. This is a legal normative research which studies norms in the legal system. The law is examined by its principles, analysed thoroughly particulary any regulations regarding mass media. Norms that correspond to mass media are juxtaposed with the principles and doctrines related to social control of the mass media to be analysed based on the inculcation of Pancasila values in the lives of Indonesian citizen. The results showed that the practice of Pancasila values in the role of the mass media had not been implemented. There are still many untrustworthy news that detrimental to social order. The mass media only contains news as a satisfactory to the society without instilling the importance of Pancasila values.
Indonesian supremacy of law principle is the ground rule to control the democracy flow in society. In order to do so, Pretrial institution is introduced. Pretrial, under Constitution Court Session Number 21/PUU-XII/2014, also has a jurisdiction in examining suspect naming procedure by investigator. Despite being regulated, there was found in which judge made decision to name a suspect, whereas the provision instructed the judge to only take measure and examine suspect naming by investigator, therefore undermining given regulation. This conceptual research conducted under normative method. Historical, grammatical, concept and case approach also applied. The result demonstrates that evaluating suspect naming could support and undermine Pancasila simultaneously.Keywords : pretrial, Pancasila, suspect naming, democracy INTISARIPraperadilan hadir sebagai bentuk pengawas terhadap peran penyidik dan penuntut umum, dalam hal ini, berdasarkan putusan Mahkamah Konstitusi Nomor 21/PUU-XII/2014 menambahkan kewenangan salah satunya untuk menguji keabsahan penetapan tersangka. Wujud kontrol yang demikian ternyata tidak sepenuhnya diterapkan oleh hakim dengan baik. Peristiwa yang menjadi bukti luputnya penerapan pemeriksaan keabsahan tersangka salah satunya dimana hakim Praperadilan memerintahkan menetapkan tersangka, dengan demikian melampaui batas kewenangan. Metode penelitian yang dilakukan adalah normatif dengan pendekatan filosofis, gramatikal, konsep dan kasus. Hasil menunjukkan bahwa wewenang Praperadilan dalam menentukan keabsahan tersangka dapat mendukung, tetapi sekaligus dapat juga menjadi alat peruntuh demokrasi Pancasila.Kata kunci : praperadilan, Pancasila, penetapan tersangka, demokrasi
Indonesia, like other countries in the world, struggles as pandemic strikes. Such condition force every subject involved in the criminal justice system to administer technology to suppress the spread of the virus by social distancing. However, the sudden turn to employ modern technology has made the justice system moved into a new place called the virtual court. This pandemic situation also forces the shift of the conventional criminal court to the virtual criminal court paradigm. This article discusses the history of virtual criminal court in Indonesian Criminal Justice. This research employs a descriptive-normative method. The information collected by applying a historical approach and theoretical approach. Relevant data then studied and evaluated. The result then explained and described clearly. Indonesia is ready to implement virtual criminal justice. The shift from formal criminal court proceeding into virtual criminal court proceeding is applicable in Indonesia since 2002.
