In this paper, the author analyzes the liability for damage to property caused by hailstorms. Although a hailstorm is a natural phenomenon, the damage caused by hail in certain situations does not represent a casus sentit dominus. The Hydrometeorological Institute of Serbia (HIS RS) has the exclusive authority to perform hail suppression activities (by seeding hail-bearing clouds with silver iodide) in order to control hail growth and reduce damage caused by hail. The issue of liability for damage caused by hail arises in case the HIS fails to perform its activities. The author focuses on cases where the compensation for damage caused by hailstorms is attainable. The lack of comprehensive scientific considerations on this subject matter has generated quite a few dilemmas in judicial practice. The author will addresses some of the most disputable issues: who is the responsible person, and what is the legal ground for establishing the liability of legal entities?
Апстракт: У раду се анализира тајно (мистично, затворено) завештање као један од облика завештања у савременим европским правним системима. Аутор је обухватио законска решења и ставове теорије о тајном завештању у француском, немачком, италијанском и руском праву, те указао на постојеће разлике у погледу услова за његову пуноважност у наведеним правима. Посебан део рада посвећен је предностима и недостацима тајног завештања. На крају, аутор даје аргументе због чега треба размислити о регулисању овог облика завештања домаћим наследноправним прописима.
The law regulates the right to maintenance between spouses and between extramarital partners, the conditions under which it can be exercised, as well as a special litigation procedure for obtaining the right to maintenance. The existential character of the right to maintenance stresses the need to examine the functional quality of the established legal mechanism. The author has conducted an empirical research on maintenance litigation proceedings between spouses and extramarital partners which were conducted before the Basic Court in Niš and finished during the year 2018. In this paper, the author presents and analyzes the results of research in litigation proceedings for establishing and varying the maintenance amount, and terminating and extending the duration of maintenance between married or unmarried, current or former partners. The aim of the research was to gain insight into the adequacy of applying relevant legal regulations in practice and the efficiency of providing legal protection in analyzed maintenance lawsuits. The research results reveal the inefficiency of maintenance litigation proceedings and a serious lack of information among citizens about the procedural possibilities in maintenance lawsuits.
