At least seven verses in the Qur’an and many hadiths highlight that riba (usury) is forbidden in Islam and should be avoided by Muslims. However, when we bring this issue into the modern context, especially its application in economics and banking, Muslims might say differently. Some Muslims with contemporary arguments could say that banks’ interest is not similar to riba because riba is only in the context of excessive lending and taking advantage of others’ needy. We survey 626 people in Indonesia and finds that 93% of Muslims said that riba is indeed prohibited in Islam, but some of them disagree if riba is similar to the conventional bank’s lending-borrowing mechanisms. In this article, we also empirically find that their involvement in the Islamic organization could strengthen their perception that riba is not similar to the bank’s interest rate.
This paper aimed to find out and to analyze the standing of inter-religious marriage based on the Surakarta district court decree according to the Compilation of Islamic law number 1 of 1974 about marriage. This study was categorized as an empirical legal study. An empirical legal study is a study utilizing the empirical fact taken from the human behavior, at the beginning of the study, the secondary data is studied and then is continued by the study on the primary data in the field or towards the community. The result of the study showed that there was a deviation on the parties who did interreligious marriage and it was considered as illegal. The parties insisted to perform the marriage by filing a request to the District Court of Surakarta. The district court of Surakarta granted the request to fill the legal gap. The decree is based on the jurisprudence. That decree commanded the Population and Civil Registration Agency to perform and record the marriage, however, in this case, the Population and Civil Registration Agency did not possess legal right to marry off the parties, its right is only to record, so the Population and Civil Registration Agency of Surakarta was only allowed to record the permission of marriage decreed by the District Court.
This article aimed to seek an understanding that inheritance in Islamic inheritance law regulated in Al-Quran can be subordinated. The nature of Islamic inheritance law is ijbari. It is defined as the property transfer from the deceased person to his/her inheritor that is applied automatically according to Allah and His prophet’ provision without depends on the will of the testator/testatrix or the inheritor. In Indonesia, inheritance is regulated in article 183 of Compilation of Islamic Law (KHI). This study employed a normative approach. Inheritance distribution that is not in accordance with Al-Quran can be done by distributing the inheritance peacefully by takharuj or tashaluh, which is justified by Maddhab Hanafi
In essence, Islamic law (Maqasid al-Shariah) and the sustainable development goals (SDGs) initiated by the United Nations have the same goal: to achieve the perfection of a sustainable human life. Meanwhile, Islamic finance is regarded as an implementation of Islamic law, as many Islamic finance products and instruments are derived from Islamic law. Prior studies on Islamic law, Islamic finance, and SDGs tend to be scattered, and the role of Islamic finance in SDGs is still questionable. This paper uses a systematic literature review to investigate the intersection of Islamic finance, Islamic law, and SDGs. We selected papers that focused on Islamic finance as an inclusion criterion and excluded papers that only discussed Islamic countries as an exclusion criterion. We retrieved 65 papers and book chapters published from 2008 to 2022 from the Scopus database to analyze which parts of Islamic finance and law can contribute to the SDGs. We use thematic analysis for data synthesis by grouping findings into their relation to Islamic law using Al-Ghazali’s Framework of Maqashid Al-Shariah and SDGs from the UN, and then explaining the research results using a narrative method. Through this study, we found that Islamic finance supports the SDGs with the most significant contribution to humanity. In addition, it is essential to know that the support of the government, regulators, and related institutions is much needed to improve Islamic finance for the achievement of SDGs.
