En el presente artículo, se abordará el valor de los intangibles de los mecanismos alternativos y se identificará qué intangibles pueden ser aplicados en mediación familiar en sede judicial y, a su vez, determinar en qué parte del proceso judicial en materia familiar deben ser implementados. Esto tiene como objetivo analizar su impacto en las familias en conflicto para que se produzca un cambio en la dirección del proceso judicial, pasar de un proceso con base en el litigio a un proceso de diálogo colaborativo, en donde las partes puedan apreciar el valor real de la mediación familiar en sede judicial a través del discurso de apertura de la mediación familiar intrajudicial.
The following article, entitled: “Family Mediation in comparative key: Argentina and Mexico”, analyzed the juridical norms related to family mediation in the Chaco Province, Argentina and Nuevo Leon State, Mexico. It was used the qualitative approach, based on the study, analysis, critical view, and comparison between the legislations of both States and theoretical scientific investigations indexed in vLex, Dialnet and Scopus to ensure the accuracy of the information. It was found that the juridical design established for family mediation not only obstructs its conception as a method to access to daily justice, but also the lack of specific regulations makes difficult to work with. From the comparative study, it was concluded the necessity of introducing juridical proceedings and good practice in the familiar mediation professional activity in the Mexican juridical system, especially the conception of the mandatory prejudicial mediation in family conflicts with children involved.

El presente artículo, titulado: “Justicia restaurativa en México: reflexiones de lege data y de lege ferenda”, tuvo como objetivo analizar, desde una perspectiva teórico-normativa, la justicia restaurativa en el ordenamiento jurídico-penal mexicano para que sean identificadas áreas de oportunidad que tributen a su perfeccionamiento de lege data y de lege ferenda. Se siguió el enfoque cualitativo de tipo transversal descriptivo y propositivo, basado en el estudio, el análisis y la crítica de la tríada doctrina-norma-jurisprudencia y las referencias bibliográficas utilizadas se ubican en bases de datos oficiales. Se encontró que el diseño previsto para la justicia restaurativa presenta insuficiencias normativas que impiden su uso cotidiano como mecanismo de acceso a la justicia penal, junto al desconocimiento de sus modelos teóricos, principios y naturaleza. Como conclusiones, se obtuvo la necesidad de perfeccionar su actual regulación en el ordenamiento jurídico-penal conforme a sus fundamentos teóricos.
