El derecho a pensión del cónyuge divorciado y su omisión en la liquidación en la sociedad de ganancialesThe right to pension of the divorced spouse and his omission in the liquidation in the profit society O direito à pensão do cônjuge divorciado e sua omissão na liquidação na sociedade de gananciais Resumen El objetivo de esta investigación ha sido conocer la posición de los operadores jurídicos de la provincia del Santa; nuestra investigación es descriptiva, de análisis documental y encuesta. Se ha analizado en la legislación, doctrina y jurisprudencia nacional, que, en la liquidación de sociedad de gananciales en caso de divorcio, no se considera los aportes en las cuentas individuales en el sistema privado de pensiones, y que el cónyuge aportó al sistema previsional, de tal modo que este, después de divorciado se vuelve a casar y fallece, será la última esposa que se beneficie con la pensión de sobrevivencia, viudez. Como resultados, se encontró omisión normativa respecto a la identificación clara de los derechos del cónyuge divorciado en materia previsional y su relación con la liquidación de la sociedad de gananciales, a opinión de los operadores del derecho en la provincia del Santa es positiva.Palabras clave: Sociedad Gananciales; pensión; sociedad conyugal. AbstractThe objective of this investigation has been to know the position of the legal operators of the province of Santa; our research is descriptive, of documentary analysis and survey. It has been analyzed in the legislation, doctrine and national jurisprudence, that, in the liquidation of partnership of property in case of divorce, the contributions in the individual accounts in the private pension system are not considered, and that the spouse contributed to the pension system, so that after being divorced he remarries and dies, he will be the last wife to benefit from the survivor's pension, widowhood. As results, a normative omission was found regarding the clear identification of the rights of the divorced spouse in social security matters and its relation to the liquidation of the community of acquisitions, to the opinion of the operators of the right in the province of Santa it is positive. Hundreds of thousands of U.S. veterans and their families are significantly affected by traumatic brain injury (TBI), yet policy-makers and the general public often lack knowledge about TBI and other “invisible injuries” related to military service. Veterans may face delayed TBI diagnoses and trouble accessing needed health care, and they and their families may face stigma and misperceptions about TBI that impede successful community reintegration. Researchers in the Department of Veterans Affairs (VA) partnered with 45 veterans with TBI and 26 of their family caregivers on a participatory action research (PAR) study that used photovoice methods to explore and convey experiences of community reintegration after TBI. Interview data and images taken by participants were used to communicate stories, reflections, and insights. This paper reports participants’ reflections about (a) how they became aware of TBI-related symptoms and the impact of TBI on their lives and relationships, (b) challenges they have encountered—including misconceptions and stigma—when disclosing TBI and other “invisible injuries” to others, and (c) strategies and resources they draw upon to counter these challenges. The authors conclude by sharing participant-identified recommendations for supporting community reintegration after military service–related TBI. This work demonstrates the power of PAR to engage veterans and family caregivers in generating knowledge to inform the programs, policies, and public discourse that affect their lives. A priority for the dissemination of the study’s findings has been to raise awareness about TBI among veterans and military caregivers.
