Notre travail est une réflexion sur la traduction du discours traductologique. Prenant comme étude de cas le chapitre « La traduction au manifeste » de l’Épreuve de l’étranger d’Antoine Berman, nous examinons les difficultés de traduction du discours bermanien et, en particulier, l’apparente intraduisibilité des concepts-clés de l’ouvrage. Notre démarche commence par un examen général de la traduisibilité du discours traductologique, qui comprend une analyse des particularités du métalangage. Par la suite, nous passons en revue les axes fondamentaux de la philosophie de Berman, pour identifier dans la dernière partie les défis d’ordre terminologique et discursifs de la traduction du discours bermanien.
The paper focuses on time marks that may be detected in common law agreements and the translation issues they imply. In the first section, the author discusses the relation between time and law. The legal time governs the social time, as it ensures order and security. If memory is the manifestation of the legal past, the promise is the expression of the legal future. Depending on the legal culture taken into account, the legislator’s time may be more or less important than the time of the judge. The second section of the paper deals with time avatars that may be identified at the macrotextual level. The contract is understood as a promise that becomes obligation. The legal time is also expressed in contracts by the predictive capability of the parties, its acceleration and backwardness, its finiteness. The last section is an analysis of the translation of terms, collocations and metaphors expressing time in common law contracts.
Our research focuses on the metatexts signed by Lucian Blaga as a translator. We prove that, due to the preference of Blaga for ethnocentric translation and his philosophy on poetic translation seen as interpretation, he is a translation theorist. The premise on which we base our research is represented by the remark belonging to Sean Cotter, according to which, in the case of Blaga, translation is a manner of challenging the linguistic policy imposed in Romania during the 1950s by the new regime. In this regard, we analyse the dichotomy margins vs centre in translation and the importance of the translation process in Romania during that decade. The pattern suggested by Lawrence Venuti in nowadays Translation Studies is reversed in the case of the translation subjected to our study: the translator abandons its “invisibility”, while ethnocentric translation becomes, in itself, a technique of resistance. The analysis of certain metatexts signed by Blaga proves that he had a modern philosophy on translation, which allows us to consider him a translation scholar avant la lettre. Thus, a careful analysis of metatexts signed by translators of that period would contribute to a greater visibility of trends existing in Romanian Translation Studies.
L'auteur souligne l'importance des compétences langagières et des connaissances encyclopédiques dans la traduction des contrats de vente du droit anglosaxon. Inspiré par les principes de la Théorie interprétative de la traduction dont il présente l'importance et l'originalité dans le domaine de la traductologie, l'article soutient que la traduction est une opération cognitive dont le succès dépend des mécanismes mis en oeuvre par le traducteur. Traduire signifie interpréter le sens d'origine, mais en faisant appel en permanence au contexte et au bagage cognitif, comme le montre la partie applicative du travail.
