The purposes of this study are to identify and describe the strengths and weaknesses of institutions as providers of inclusive education with using the instruments that have been prepared. Evaluations are conducted to identify and explain both the opportunity and challenge of an institution that is able to be used for the institutional development in the implementation of inclusive education. The evaluation of the inclusive education at primary schools is intended as a process of identifying the indicator of the implementation of the inclusive education and finds out an event what is being done, what was done, and what is not done yet in implementing the inclusive education program at primary schools. This research uses a descriptive method with a quantitative approach. The sampling technique is used by surveying 5 primary schools with a sample of 30 teachers who taught children with special needs. The Evaluation data includes the data of general school, school-specific data and data on the implementation of inclusive schools. The data are collected using the ideal instrument index. The result of the general school is 11.6 with the ideal standard score of 19. The specific data of the inclusive school amounts to 104.2 with the ideal score of 138. While for the implementation of inclusive education data amounts to 159.1 with a total score of 381. The Conclusions of this study are the evaluation of the implementation of inclusive education at the primary school in Kebumen regency showed the mean is 60% in the medium category. This result implies that the implementation of inclusive schools in the regency of Kebumen needs to be optimized in terms of institution, curriculum, learning, appraisal, student affairs, human resources, facilities and infrastructure, finance and society participation.
The massive development in business and the economy has provided new opportunities for the people in Indonesia, especially with the dream of improving careers and wages. However, at the same time, the recruiting system aiming to get the best workers is so complex that even it creates a new system called outsourcing. Unfortunately, this system has a few disadvantages for workers, especially concerning diploma detention cases. This study aims to analyze the legal protection for outsourced workers/laborers in Indonesia. This research uses the normative legal research method. The legal material secondary to this study is literature dealing with research problems. For processing the data, a conceptual approach and a statutory approach are used, and then descriptive research is used to produce a descriptive analysis. Although the issue of diploma detention is not commonly discussed in Indonesia, it can be said that the core of this problem is the minimum knowledge of the law and regulations. Thus, legal protection based on Indonesian Law and Regulation for the outsourced workers/laborers should be openly socialized to all outsourced workers/laborers. To limit the scope of this study, the analysis concerns to analyze the legal protection for outsourced workers/laborers in Indonesia based on the applicable law. The novelty of this research study is to provide a better idea and understand the possibility of criminal sanction for employers as one Legal Protection form for outsourced workers/laborers.
The research discussed a stereotyping representation of Special Agent Kensi Blye, one of the female characters in the crime drama series ‘NCIS: Los Angeles series’. In the crime drama genre, a very masculine genre, the notion of a female character having masculine traits was common. Another issue was how the other male characters in the television show saw Kensi Blye. Their willingness to openly accept that Kensi Blye had more masculine traits than her feminine traits would be discussed. To analyze the representation of Kensi Blye, the three-dimensional framework was used as the approach. The research data were gathered from the utterances expressed by Kensi Blye’s co-workers about Kensi. The textual analysis would be the analysis of obtained data using a social actor network. Then, the resulting data would be analyzed using the feminine and masculine traits to find out how the other co-workers represent Kensi Blye’s character. The finding suggests that as the only female field agent, Kensi Blye seems to have a strong character, but in certain situations, her male co-workers still question her femaleness. The stereotyping of femaleness in female characters is inevitable even in the masculine genre of television cinema.
Kejahatan atau tindak pidana oleh korporasi terhadap pekerja dimungkinkan terjadi mengingat semakin meningkatnya persaingan usaha ditengah menyempitnya lapangan kerja. oleh karenanya penelitian ini dibuat bertujuan untuk mengetahui bentuk tindak pidana oleh korporasi terhadap pekerja dan cara penyelesaiannya. Untuk menjawab permasalahan tersebut, penelitian ini dilakukan dengan cara studi kepustakaan hukum positif terkait ketenagakerjaan melalui logika berpikir deduktif-induktif dan hasil pengamatan yang dilakukan oleh peneliti. Hasil penelitian menunjukkan bahwa bentuk tindak pidana oleh korporasi dikategorikan berupa tindak pidana kejahatan dan pelanggaran sedangkan penyelesaiannya belum dapat menjerat korporasi secara langsung karena tindak pidana oleh korporasi terhadap pekerja merupakan delik aduan yang berpotensi mengakibatkan kerugian yang lebih besar bagi korban tindak pidana, selain itu profesionalitas dan kompetensi penegak hukum dibidang ketenagakerjaan tidak berimbang dengan tingkat kompleksitas tindak pidana serta inkonsistensi peraturan perundang-undangang mengakibatkan sulit terwujudnya penegakan hukum tindak pidana oleh korporasi terhadap pekerja sehingga dibutuhkan terobosan hukum atau cara yang dapat memulihkan hubungan diantara keduanya baik pelaku maupun korban
Penelitian ini bertujuan untuk memberikan gambaran terkait dampak penerapan kebijakan pemerintah akibat Covid-19 terhadap status hubungan kerja yang berimplikasi pada pengupahan tenaga kerja dalam situasi pandemi covid-19 yang didasarkan pada perspektif pembaharuan hukum di perusahaan persepatuan Kota Surabaya. Adapun penelitian yang dilaukan saat ini yaitu penelitian yuridis normatif yang menekankan pada studi kepustakaan, perundang-undangan, karya ilmiah/jurnal, pendapat para pakar, dan juga mendekatkan pada yuridis sosiologis dengan pengamatan langsung terhadap objek yang sedang diteliti. Untuk menghindari perselisihan antara pengusaha dengan pekerja yang disebabkan pemutusan hubungan kerja terhadap pekerja, maka sebaiknya pemutusan hubungan kerja dihindari atau setidaknya jadi upaya terakhir dalam keberlangsungan hubungan kerja antara pengusaha dengan pekerja, oleh sebab itu diperlukan penerimaan atau kesepakatan kedua belah pihak dengan ide dan pemikiran yang sama-sama memberikan solusi untuk menentukan jalan tengah, sehingga pekerja maupun pengusaha dapat menerima dengan baik atas keputusan pemutusan hubungan kerja atau kebijakan lain yang akan ditempuh. Relevansi penelitian menunjukan bahwa dalam hal perlindungan pengupahan dan perlindungan bagi tenaga kerja di tempat kerja pengusaha dapat melakukan penangguhan pembayaran upah (jika pengusaha tidak mampu membayar upah sesuai upah minimum), dengan terlebih dahulu melakukan perundingan dengan pekerja/buruh atau serikat pekerja/serikat buruh terkait penangguhan tersebut. Penangguhan pembayaran upah minimum oleh pengusaha kepada pekerja/buruh tidak serta-merta menghilangkan kewajiban pengusaha untuk membayar selisih upah minimum selama masa penangguhan, para pimpinan perusahaan diharapkan dapat mengambil langkah preventif terkait risiko efisiensi pengurangan tenaga kerja dengan melakukan pekerjaan di rumah.
