Introduction: this article offers a comparative analysis of systematization of the results of intellectual activity in the Russian Federation and abroad. Systems for the registration of creative works in various countries, including Russia, function in different areas. There are registers in libraries and archives, as well as those maintained by organizations for the collective management of rights. In Europe, for example, a register of so-called orphan works (works whose authors are unknown) has been created. At the same time, the fact that a variety of such registers exist often makes commercialization of copyrighted objects quite difficult, especially if the turnover in rights to such objects takes place predominantly on the Internet. This article considers various registration systems for the results of creative work and identifies possibilities for the application of blockchain technologies to the systematization of such results. Purpose: to identify regulatory models for the systematization of the results of creative work in the digital sphere for the purpose of using blockchain technologies for the registration of rights to the results of intellectual activity. Methods: the methodological framework of the research is based on dialectical, formal, functional and other general research methods, as well as special methods used by legal scholars: comparative law research and technical research. Results: the authors have identified and described the existing Russian and foreign mechanisms utilized for the systematization of the results of creative work. Based on the comparative analysis offered herein, the possibilities of using blockchain technologies to systematize the results of intellectual activity have been demonstrated for the purpose of the subsequent creation of a single register of intellectual property. Conclusions: the analysis of systematization of the results of intellectual activity in accordance with Russian law and laws of some foreign countries enables us to conclude that the use of blockchain technologies for the purpose of systematizing the results of intellectual activity makes it possible to store, disseminate and transfer information about copyright objects and
Аннотация. В рамках настоящей статьи проведено исследование конструкции смартконтракта с позиций юриспруденции и технических наук, проанализирована его юридическая природа, рассмотрены вопросы о сфере применения смарт-контрактов (в соотношении с технологией распределенных реестров). Авторами сделаны выводы о том, что категорию «смарт-контракт» можно определить в техническом и юридическом аспекте. В зарубежной литературе различаются две категории: legal smart contract и smart contract code (или smart contract). Смарт-контракт как техническое явление представляет собой компьютерный код, позволяющий автоматизированно исполнять обязательства. С юридической точки зрения подходы к определению смарт-контракта зависят прежде всего от того, исходят авторы из возможности применения смарт-контрактов только в рамах технологии распределенных реестров или в рамках иных информационных технологий. При этом большинство авторов придерживаются мнения о том, что смарт-контракт существует исключительно применительно к технологии распределенных реестров, а именно блокчейна. В статье предложено определение смарт-контракта как типовой (специальной) договорной конструкции -договора, заключенного с помощью электронных либо иных технических средств, по условиям которого исполнение обязательства осуществляется без направленного отдельно выраженного дополнительного волеизъявления (на основании новой редакции ч. 2 ст. 309 ГК РФ). Изложена позиция о том, что смарт-контракт не может быть квалифицирован в качестве самостоятельного способа обеспечения исполнения обязательств. Такая его квалификация возможна лишь при абсолютизации функционального подхода к пониманию обеспечительных средств.
This article describes systems of accounting for the results of creative work, reveals possibilities for Blockchain`s technology applicability for providing information about the protected results of intellectual activity and their inclusion in the turnover (commercialization). Legal mechanisms play an important role for successful implementation of the opportunities which form the basis of this technology. It also requires addressing the unjustified legal obstacles for applicability of the technology and, at the same time, deciding which includes the technology into established legal mechanisms. Authors analyze the main issues which may arise when including the results of intellectual activity into accounting systems based on Blockchain technologies.
The paper discusses the issues that arise when creating a virtual image in multimedia products, including computer games, using the image of a citizen. As a rule, such images are used without the consent of a citizen, and therefore disputes have begun to arise regarding the legitimacy of using real images of artists in computer games, social networks. The author analyzes the legal nature of the right to an image of a citizen and the possibility of using such an image in virtual and augmented reality. In connection with the development of digital technologies, the images of citizens are now actively being used in creation of various works, such as holograms. The dance moves are being used to create digital results of creative work. The author notes that when getting results of creative work in virtual reality, it is necessary to observe the rights of citizens, whose images are used to create digital objects. When considering these issues, an analysis of foreign experience is provided, as well as mechanisms for legal regulation of relations arising in the cases under consideration.
