Indonesia is a unitary state on which national law applies in all of its provinces. The National Law which is applied throughout Indonesia regulates the civil, criminal, commercial, and other aspects of Indonesian society. However, an exception to the application of the national law exists in the province of Nanggroe Aceh Darussalam, especially in the type of sanctions applicable towards defendants who have committed or violated criminal law in Nanggroe Aceh Darussalam. Nanggroe Aceh Darussalam implements a different criminal law that derives from the National criminal law applicable to other regions in Indonesia. This is due to the promulgation of Law No. 11 of 2006 on the Aceh Government, which gave Aceh province special authority to adopt and practice Islamic law to its people. One form of punishment applied in Nanggroe Aceh Darussalam is the practice of public flogging carried out in public. This form of sanction has attracted the attention of the UN Special Rapporteur who recommended that the sentence be abolished, due to its practice which is contrary to international conventions that have been ratified by Indonesia. This article will discuss the legalization of the practice of public flogging in Indonesia in accordance with the international conventions on which Indonesia is a member thereof.Keywords : Public Flogging, Human Right, Nanggroe Aceh DarussalamAbstrakIndonesia adalah negara kesatuan yang hukum nasionalnya berlaku di semua provinsinya. Hukum Nasional yang berlaku di seluruh Indonesia mengatur tentang perdata, pidana, niaga, dan aspek-aspek masyarakat Indonesia lainnya. Namun, terdapat pengecualian terhadap penerapan hukum nasional di Provinsi Nanggroe Aceh Darussalam, terutama dalam jenis sanksi yang berlaku terhadap terdakwa yang telah melakukan atau melanggar hukum pidana di Nanggroe Aceh Darussalam. Nanggroe Aceh Darussalam menerapkan hukum pidana yang berbeda yang berasal dari hukum pidana Nasional yang berlaku di daerah lain di Indonesia. Hal ini dikarenakan lahirnya Undang-Undang Nomor 11 Tahun 2006 tentang Pemerintahan Aceh yang memberikan kewenangan khusus kepada Provinsi Aceh untuk mengadopsi dan mengamalkan syariat Islam kepada masyarakatnya. Salah satu bentuk hukuman yang diterapkan di Nanggroe Aceh Darussalam adalah praktik pencambukan di muka umum. Bentuk sanksi ini menarik perhatian Pelapor Khusus PBB yang merekomendasikan agar hukuman tersebut dihapuskan, karena praktiknya yang bertentangan dengan konvensi internasional yang telah diratifikasi oleh Indonesia. Justice Collaborators are suspects, defendants, convicts who cooperate with law enforcement to reveal a certain criminal offense. In narcotics crime Justice Collaborators are used as a tool in uncovering, fighting, organized cases. Justice Collaborator is an extraordinary crime (Extra Ordinary Crime), where the perpetrator needs protection. The formulation of the problem in this study is how the protection, rights and obligations of Justice Collaborators and the analysis of the application of Justice Collaborators in Case Study of Criminal Case Decision Number: 1273/PID.SUS/2019/PN.Plg. This research uses a study with qualitative normative juridical methods, which is research obtained from secondary sources. This research is an analysis that analyzes the protection system, rights, and obligations as a Justice Collaborator by using secondary data, namely Supreme Court Circular Letter No. 04 of 2011 concerning Treatment of Criminal Reporters and Cooperating Perpetrators, and also using other secondary legal materials such as books, journals, and the internet. From the results of this study, it can be concluded that Justice Collaborators are defendants whose interests and protection rights must be applied as perpetrators who reveal an organized crime
Community service is carried out by the Faculty of Law at the Christian University of Indonesia by providing legal counseling on national health insurance as fulfillment of the right to public health. This activity was held by the Singasari Village Office which is located at Jl. Cihaur Raya No. 17 Jonggol, Bogor. The method used is to provide counseling/lectures. The results legal counseling are “very effective considering that there are still many people who do not get information on the national health insurance provided by the Government. With this legal counseling, the community will become aware of this program and what benefits can be obtained, such as the existence of multiple benefits, medically and non-medically.”
This article analyses how Indonesia as World Trade Organization Member State, may utilize and apply Trade Policy Review Mechanism's Review Outcome to prevent dispute settlement in the Dispute Settlement Body. This article consists of two legal issues, the first issues discuss how Indonesia may utilize the TPRM Review Outcome to prevent dispute in DSB Appellate Body. Meanwhile, the second issues discuss how Indonesia may apply the TPRM Review Outcome to prevent such dispute settlement. By applying Indonesia v. Brazil Dispute concerning Indonesia Measures on Brazil Chicken Meat and Chicken Product Case as this article's minor premise, writers may explain how TPRM Review Outcome may provide an individual well to Indonesia as the WTO Member States and may represent WTO's Common Will to achieve free trade. Furthermore, writers also explain how Indonesia may apply the TPRM Review Outcome which is by conducting bilateral cooperation with Brazil. This cooperation shall Indonesia conducted by involving Indonesia National Consumer Protection Agency as one of its technical negotiation teams and Indonesia Halal Product Assurance Agency as one of its operational negotiation teams. Furthermore, this cooperation shall also entail measures that abolish Indonesia's quantitative restriction measure or safeguard policy application.
