This research is a Socio-Legal Analysis of the Role of Customary Institutions in Resolving Land Conflicts in Customary Forests in the Merauke Regency Region, while the problems to be studied are about how the position of customary forests belonging to the Marind customary community in the Merauke Regency area is in the perspective of legislation and how the process of transitioning customary forest land by the Marind indigenous people in the Merauke Regency area. The purpose of this study was to find out how the position of the customary forest belonging to the Marind customary community in the Merauke Regency area is in the perspective of legislation and to find out the process of resolving forest land conflicts by the Marind customary community in the Merauke Regency area. The research method used in this research is Juridical Sociolegal. This research is a study that looks at law through a combination of normative analysis (legal norms, juridical) and non-legal science approaches. Based on the Papua Province Perdasus Number 23 of 2008 concerning the Ulayat Rights of Indigenous Law Communities and Individual Rights of Indigenous Peoples to the Land of the Indigenous Peoples, Marind Imbuti, the owner of customary land in the Veterans area of Merauke Regency, does not own customary forest, but owns land or customary forest. The process of transitioning the Ulayat Forest belonging to the Marind Imbuti customary community inhabiting the Merauke Regency area must go through the Customary Process and Administrative Process, both of which are quite strict and selective.
Tujuan penelitian ini adalah untuk mengetahui implementasi dari UU Nomor 27 tahun 1980 tentang penggolongan bahan-bahan galian mulai dari penetapan, pengelolaan , dan pemanfaatan yang berdasarkan analisis mengenai dampak lingkungan di kampung kumbe distrik malind kabupaten merauke. Untuk mendapatkan data maka peneliti melakukan wawancara kepada 8 informan menggunakan metode penelitian hukum dengan Teknik analisis data yang digunakan dalam penelitian hukum ini adalah analisis data kualitatif, yaitu suatu tata cara penelitian yang menghasilkan data deskriptif analitis. Hasil penelitian ini menunjukan bahwa implementasi dari peraturan pemerintah nomor 27 Tahun 1980 mempengaruhi dampak lingkungan di kampung kumbe distrik malind Kabupaten Merauke, sehingga terdapat beberapa aspek yang di rugikan yaitu : a) aspek sosial budaya, tentang bagaimana masyarakat adat mempertahankan budayanya yang semakin hari semakin terkikis. b) aspek sumberdaya alam, tentang bagaimana pemerintah dalam hal ini yang bertanggung jawab mempertahankan sumberdaya alam untuk generasi yang akan datang. c) aspek Ekonomi, tentang bagaimana dampak yang ditimbulkan akibat penggalian yang tidak terkontrol terhadap pertumbuhan ekonomi di Kampung Kumbe dan Pendapatan Asli Daerah. d) aspek hukum dan kebijakan, tentang bagaimana kebijakan yang di keluarkan mengakibatkan kekosongan hukum di kampung kumbe distrik malind Kabupaten Merauke.
This study aims to optimize the implementation of the legislative function in the village consultative organization. This study using sociolegal law research methods, data collection techniques used are interviews, direct observation, literature study. All data obtained from this study, both primary data, secondary data, and tertiary data, are then processed and analyzed qualitatively for further description in order to provide understanding by explaining the results of this study, ideally, it discusses and agrees on a village regulation draft from the right of initiative. The proposal purpose is to gather the aspirations from the village community and stipulated in a village regulation product. However, the implementation of proposals and designs proposed by the Village Deliberative Council was low, resulting in the lack of village regulations being produced. There are 179 villages in Merauke district, none of it has village regulation product initiatively.. The decline performance of the Village Deliberative Council will result in ineffective legislative functions. Appropriate regulations, namely renewal and improvement in terms of Quality, Quantity, Timeliness, Effectiveness, Independence, Environment, become benchmarks in optimizing the legislative function of Village Deliberative Council. Something questionable here is whether the village community can follow the changes or reject the changes.
