<p><em>This study aims to provide confirmation of the accommodation of disclosure which is still questionable in the cluster of international regulations, this is done in order to obtain the same interpretation of regulations in international practice for the protection of Genetic Resources and Traditional Knowledge (SDGPT), which is also an implication of the existing system in Law Number 13 of 2016 concerning Patents has not been able to protect it optimally. By using a normative juridical method with qualitative analysis, this study justifies the results that have been in previous studies that the beneficial sharing mechanism has become the government's effort to protect SDGPT from acts of misappropriation, but this research found a novelty, namely by supporting the affirmation and perfecting of these matters which need to be acknowledged are not sufficient to meet the needs of international practice, because it was found that there are still Indonesian State patents taken without beneficialy sharing due to the plurality of interpretations and accommodations of the Patent Law which are not in accordance with international practice requirements. Thus, the accommodation of disclosure or the formulation of disclosure requirements deserves a position in the regulation of the Patent Law in Indonesia for steps to encourage the sound of the same interpretation in the echoes of international practices and regulations, so that the benefits can be maintained and felt by people of origin.</em></p><p>Penelitian ini bertujuan untuk memberikan penegasan terhadap akomodasi pengungkapan yang masih menyoal dalam rumpun regulasi internasional, hal ini dilakukan guna mendapatkan penafsiran regulasi yang sama dalam praktik internasional atas perlindungan Sumber Daya Genetik dan Pengetahuan Tradisional (SDGPT), yang juga merupakan implikasi dari sistem yang ada dalam Undang-Undang Nomor 13 Tahun 2016 tentang Paten belum dapat melindungi secara maksimal. Keterbatasan pemahaman masyarakat tradisional di negara berkembang yang seringkali dibenturkan dengan orientasi komersil yang dimiliki oleh masyarakat di negara maju dalam pemanfaatan SDGPT dengan membuat paten. Dengan menggunakan metode yuridis normatif dengan analisis kualititif, penelitian ini menjustifikasi hasil yang telah ada dalam penelitian-penelitian terdahulu bahwa mekanisme <em>beneficialy sharing</em> telah menjadi upaya pemerintah dalam melindungi SDGPT dari tindakan <em>misappropriation</em>, namun penelitian ini mendapati kebaruan yaitu dengan menyokong penegasan dan menyempurnakan hal tersebut yang perlu diakui tidak cukup untuk memenuhi kebutuhan praktik internasional, karena ditemukan hasil bahwa masih terdapat paten Negara Indonesia yang diambil tanpa <em>beneficialy sharing</em> karena kemajemukan penafsiran dan akomodasi UU Paten yang tidak sesuai dengan kebutuhan praktik secara internasional. Maka, akomodasi pengungkapan atau rumusan <em>disclosure requirements</em> layak mendapatkan posisi dalam regulasi UU Paten di Indonesia untuk langkah mendorong suara penafsiran yang sama dalam gaungan praktik dan regulasi internasional, sehingga manfaat dapat tetap terjaga dan dirasakan oleh masyarakat asal.</p><p> </p><p> </p><p><strong><em> </em></strong><em> </em><em></em></p>
This research is motivated by the increase in the crime rate in the Banjar Police jurisdiction in 2020, which was 27 (twenty seven) cases compared to the previous year which amounted to 14 (fourteen) cases. The data shows that the performance of the Banjar Police Sat Sabhara in carrying out patrol duties has experienced a decline. The method used in this study is a normative juridical approach, namely testing and reviewing secondary data. This research was conducted in two stages, namely library research and field research which is only supporting. The results of the study show that based on Article 55 paragraph (1) of the National Police Perkap No. 23 of 2010, Sat Sabhara has a position as an element of implementing the main tasks under the Chief of Police. As an implementing element for the main task, the Sat Sabhara has a role and function in terms of maintaining Kamtibmas through regulating, guarding, patrolling, escorting and community service activities and early-stage enforcement efforts. There are several obstacles faced by Sat Sabhara in carrying out patrol activities, namely the lack of good planning and the less than optimal implementation of patrols. The efforts that must be made are to evaluate planning and maximize patrol activities by increasing the number of human resources and adding facilities and infrastructure to support activities.Penelitian ini dilatarbelakangi oleh meningkatnya angka kriminalitas di wilayah hukum Polres Banjar pada tahun 2020 yaitu sebanyak 27 (dua puluh tujuh) kasus dibanding tahun sebelumnya yang berjumlah sebanyak 14 (empat belas) kasus. Data tersebut menunjukan kinerja Sat Sabhara Polres Banjar dalam melaksanakan tugas patroli mengalami kemunduran. Metode yang digunakan dalam penelitian ini adalah pendekatan yuridis normatif, yaitu menguji dan mengkaji data sekunder. Penelitian ini dilakukan melalui dua tahap yaitu studi kepustakaan dan penelitian lapangan yang hanya bersifat penunjang. Hasil penelitian menunjukan bahwa berdasarkan Pasal 55 ayat (1) Perkap Polri No. 23 Tahun 2010, Sat Sabhara mempunyai kedudukan sebagai unsur pelaksana tugas pokok yang berada di bawah Kapolres. Sebagai unsur pelaksana tugas pokok, Sat Sabhara mempunyai peran dan fungsi dalam hal pemeliharaan Kamtibmas melalui kegiatan pengaturan, penjagaan, patroli, pengawalan serta pelayanan masyarakat dan upaya penindakan tahap awal. Ada beberapa hambatan yang dihadapi Sat Sabhara dalam melaksanakan kegiatan patroli yaitu kurangnya perencanaan yang baik dan kurang maksimalnya pelaksanaan patroli. Adapun upaya yang harus dilakukan adalah melakukan evaluasi perencanaan dan memaksimalkan kegiatan patroli dengan meningkatkan jumlah SDM dan menambah sarana dan prasarana penunjang kegiatan.

The position of other rights of workers or laborers with the Constitutional Court Decision Number 67/PUU-XI/2013 takes precedence over claims for state rights, auction offices, and public bodies established by the Government. But the status of other rights of workers or laborers is still under the bill of wage rights and separatist creditors. So in practice, if a company is declared bankrupt, then the other rights of workers or workers are in third position after the settlement of wage rights and claims of separatist creditors. The Bankruptcy Law is revised or amended again, so that the rights of each creditor that have been regulated in other laws do not overlap, so that its implementation is not too difficult in reality.Pada prinsipnya semua upah buruh yang tertunggak wajib dibayarkan setelah aset Debitur yang pailit dijual dan daftar Pembagian sudah ditetapkan oleh Pengadilan berdasarkan atas usulan kurator. Sedangkan berdasarkan Putusan MK No. 67/PUU-XI/2013, MK telah secara tegas memberikan perlindungan terhadap hak pekerja dengan memberikan kepastian hukum untuk memprioritaskan hak pekerja agar dapat memperoleh haknya sendiri dalam hal perusahaan yang bersangkutan mengalami kepailitan. Kedudukan hak-hak lain pekerja atau buruh dengan adanya Putusan Mahkamah Konstitusi Nomor 67/PUU-XI/2013 didahulukan atas tagihan hak negara, kantor lelang, dan badan umum yang dibentuk Pemerintah. Tetapi kedudukan hak-hak lain pekerja atau buruh masih berada di bawah tagihan hak upah dan kreditur separatis. Sehingga pada praktiknya apabila suatu perusahaan diputuskan pailit, maka hak-hak lain pekerja atau buruh berada di posisi ketiga setelah pelunasan hak upah dan tagihan kreditur separatis. Undang-Undang Kepailitan diperbaiki ataudiubah lagi, agar hak-hak setiap kreditor yang telah diatur dalam perundang-undangan lainnya tidak tumpang tindih, sehingga penerapan dalam kenyataannya tidak terlalu sulit.
