RESUMOA regularização fundiária de interesse social visa à melhoria das condições de vida das populações urbanas, conciliando com a melhoria das condições ambientais das áreas em questão. No entanto, problemas são encontrados para a execução dos instrumentos previstos em lei. Sendo assim, o presente trabalho visou discutir a relação existente entre a regularização fundiária urbana de áreas de interesse social e os problemas para a aplicação dos instrumentos ambientais, correlacionando com o processo de regularização fundiária ocorrido em Serra-ES. Foi possível constatar que, para que as melhorias propostas ocorram, todas as etapas da regularização devem ser desenvolvidas em conjunto. Também foram apontados como fatores-chave para a melhoria das condições ambientais: a fiscalização mais efetiva, para que não ocorra a conversão de novas áreas e o respeito às áreas mínimas de preservação permanente descritas em Lei. ABSTRACTLand regularization of social interest aims to improve the living conditions of urban populations, combining with the improvement of environmental conditions in these areas. However, problems were found for the implementation of instruments provided by law. Therefore, this study aimed to discuss the relationship between urban land regularization areas of social concern and difficulties for the implementation of environmental instruments, correlating to the study of land regularization process that was executed in Serra -ES state. It was possible to see that, for proposed improvement to occur, all stages of regularization should be developed together. Key factors were also identified for the improvement of environmental conditions: effective inspection, preventing the conversion of new areas, and respect for the minimum permanent preservation areas described in law. INTRODUÇÃONa segunda metade do século XX, acompanhando o desenvolvimento das indústrias, o crescimento do número de postos de trabalhos nas cidades e o atraso para a chegada de tecnologias no meio rural, inúmeras pessoas passaram a deixar o campo em busca de melhores condições de vida nas cidades. Este processo, que ficou conhecido como êxodo rural, vem se expandindo até hoje, passando de 100 milhões o número de pessoas que se mudaram para áreas urbanas nas últimas décadas (IBGE, 2010).O mesmo êxodo causador de consequências positivas para as indústrias que passavam, inicialmente,
Urban growth is often accompanied by significant environmental changes, which include modification of the natural landscape and the problems related to it, such as real estate speculation, marginalization of the population, landslide risks, flooding, as well as pressure on environmentally protected areas. Therefore, it is necessary to understand how will new urban development affect the already modified space without generating further environmental problems. The research aimed to analyse five projects of allotments in Governador Valadares/Brazil between 2015 and 2017. Besides the information on the projects themselves, geographic information systems (GIS) were used along with laws and bibliography. The biggest obstacle observed was the lack of standardization in the process required by the City Hall, which culminated in projects with different characteristics, including those that did not present important analyzes, such as the Civil Construction Waste Management Plan. It is necessary to move forward in discussions related to urban environmental sustainability, standardizing the possible actions, not only in the municipality of Governador Valadares.
