Is the 12-hour workday for 36 hours of rest harmful to the health of the worker? The present study aimed to analyze the 12-hour work day for 36 hours of rest is detrimental to the health of the worker and is considered as one of the villains with records of most work accidents. The methodology used was through the bibliographic review, he observed, that the flexibilization of labor standards in Brazil is very present in all segments of the activity, including, with the withdrawal of labor rights conquered at the time of history and that favors only the employers. It also analyzed the regulation of working hours 12 x 36, through Law 13467/17, which added article 59-A of the Consolidation of Labor Laws, enabling the employee and the employer to enter into an adjustment agreement such a day, which previously was only allowed by means of an agreement or collective bargaining agreement.
O presente trabalho tem como objetivo apresentar a importância da seguridade social para a sociedade brasileira, expondo a atuação de todos os partícipes nesse processo. Possuindo o objetivo geral de apresentar como a seguridade social vem se desenvolvendo no país, este artigo buscou através do passeio histórico apresentar a evolução da seguridade social no Brasil, e como seus princípios foram sendo positivados na constituição vigente. Analisar de maneira imparcial os possíveis benefícios e nocividades da legislação atual, possibilitou que o trabalho fosse delineado expondo a verdade acerca do processo de construção da seguridade social brasileira. Cabe destacar que as regras que norteiam o sistema securitário estão descritas na Constituição de 1988, somado a isso as Leis 8.212 de 1991 e 8.213 de 1991 que tratam da organização e planos de benefícios, respectivamente, dão subsidio de como a seguridade social é de grande notoriedade social e quem são seus contribuintes. Para tanto, utilizou-se como metodologia a pesquisa exploratória, baseada na análise bibliográfica de doutrinadores acerca do tema. Por fim, trata-se do sistema previdenciário e seu regime geral e as diferenças sobre a seguridade social.
The principle of jus postulandi established by Article 791 of the Labor Code is a faculty that shares procedural relationships have to seek a judicial response without the need of hiring a lawyer. Thus, this article aims to analyze this institute, seeking to assess their compatibility with the fundamental guarantee of access to justice positively valued in Article 5, XXXV; the Brazilian Constitution of 1988. The study deals with a literature in which the survey information, the expert authors, through books, journal articles and websites, served to further consideration of the validity of jus postulandi despite have the intention to facilitate access to justice, has shown little used and somehow damaging for those who use, because the process is not reaching the intended purposes becoming thus an utopia in labor legal system.
