Land reform is an overhaul of ownership and control of agricultural land and legal relations related to land acquisition. The purpose of holding land reform is to enhance income and standard of living of smallholder farmers as a foundation or prerequisite for carrying out economic development towards a just and prosperous society based on Pancasila. The purpose of the land reform implementation is by the government distributing land to the community (farmers) by giving ownership rights, but the ownership rights cannot be traded for 10 years and there must be an authorized permit. This is contrary to the concept of ownership rights in the UUPA, which states that property rights are hereditary, strongest, fulfilled rights that people can have on land by looking at Article 6 regarding social functions. The strongest meaning of ownership rights over land is stronger than other ownership rights and does not have a term. The method used in this research is normative juridical which prioritizes secondary data in the form of primary legal materials, secondary legal materials, and tertiary legal materials. Then the secondary data is described and analysed using the theory of land law in the UUPA.
Abstract. Fiduciary Guarantee is regulated in Law No. 42 of 1999. Especially in Article 1 number 1 states that this fiduciary guarantee is the submission of property rights on the basis of trust in moving objects both tangible and intangible and non-moving objects especially buildings that cannot be burdened with dependent rights. In the event of a promise injury, there will be a process of execution of fiduciary guarantee objects contained in the fiduciary guarantee certificate that has the executive power as the court's decision that has permanent legal force stipulated in Article 15 of Law No. 42 of 1999 on Fiduciary Guarantee. The nature of the execution of Fiduciary Guarantee does not have to wait for the court's decision because the nature of the fiduciary certificate has the same legal force as the court's decision or inkracht. After the decision of the Constitutional Court No. 18/PUU-XVII/2019 creditors cannot carry out the execution of fiduciary guarantee objects on the basis of the executory title contained in the Fiduciary Guarantee certificate. Where this certainly makes concerns in the business world, especially financing institutions. This thesis writing aims to obtain results related to the execution of fiduciary bail objects after the birth of the Constitutional Court ruling and to get justice in the execution of fiduciary bail objects. This research study uses a normative juridical approach using analytical dedexriptive research specifications, data collection techniques used are literature methods using secondary data consisting of primary, secondary, and tertiary legal materials, and data analysis methods with qualitative normative. The result of this study is that the interpretation carried out by the Supreme Constitutional Court regarding Article 15 raises new problems that harm the creditors and justice that should have existed becomes un-implemented as it should be. Abstrak. Jaminan Fidusia diatur dalam Undang-Undang Nomor 42 Tahun 1999. Khusunya pada Pasal 1 angka 1 menyatakan bahwa Jaminan fidusia ini adalah penyerahan hak kepemilikan dengan dasar kepercayaan atas benda bergerak baik berwujud maupun tidak berwujud dan benda tidak bergerak khusunya bangunan yang tidak dapat dibebani hak tanggungan. Dalam hal terjadinya cidera janji maka, akan terjadinya suatu proses eksekusi objek jaminan fidusia yang terkandung dalam sertifikat jaminan fidusia yang memiliki kekuatan eksekutorial selayaknya putusan pengadilan yang telah berkekuatan hukum tetap yang diatur dalam Pasal 15 Undang-Undang Nomor 42 Tahun 1999 tentang Jaminan Fidusia. Sifat dari pelaksanaan eksekusi Jaminan Fidusia tidak harus menunggu putusan pengadilan dikarenakan sifat sertifikat fidusia tersebut berkekuatan hukum sama dengan putusan pengadilan atau inkracht. Pasca putusan Mahkamah Konstitusi Nomor 18/PUU-XVII/2019 kreditur tidak dapat melakukan eksekusi objek jaminan fidusia atas dasar titel eksekutorial yang terkandung dalam sertifikat Jaminan Fidusia. Dimana hal ini tentunya membuat kekhawatiran dalam dunia usaha khususnya lembaga pembiayaan. Penulisan skripsi ini bertujuan untuk mendapatkan hasil terkait dengan eksekusi objek jaminan fidusia pasca lahirnya putusan Mahkamah Konstitusi dan untuk mendapatkan keadilan dalam pelaksanaan eksekusi objek jaminan fidusia. Kajian penelitian ini menggunakan pendekatan yuridis normative dengan menggunakan spesifikasi penelitian deksriptif analitis, teknik pengumpulan data yang digunakan adalah metode kepustakaan dengan menggunakan data-data sekunder yang terdiri dari bahan hukum primer, sekunder, dan tersier, serta metode Analisa data dengan normative kualitatif. Hasil dari penelitian ini adalah bahwsannya penafsiran yang dilakukan oleh Mahakamh Konstitusi terkait Pasal 15 menimbulkan permasalahan baru yang merugikan pihak kreditur serta keadilan yang telah seharusnya ada menjadi tidak terlaksana sebagaimana mestinya.
Abstract. The role of land as one of Indonesia's state assets is very basic because the state and nation live and develop on land. The population and development activities in the city of Bandung are increasing. However, the availability of land for development is increasingly limited, especially in the construction of settlements so that many people are forced to build settlements in places where they should not be, one of which is the cemetery land at TPU Cikadut, Bandung City, which has changed its function to become a residential area. This study aims to determine the murder of a house on the land of a public cemetery belonging to the Bandung City government at the Cikadut Public Cemetery and the legal efforts that have been made by the Regional Government of Bandung City against the looting of a house on the land of a public cemetery. This research is a normative juridical research using an approach that emphasizes legal norms based on literature and secondary data. The specification of this writing is descriptive analysis, which describes and analyzes itself by including the laws and regulations associated with the theory and implementation of positive law. This writing data collection technique is a literature study and field studies with interviews. This research data analysis method is normative-qualitative. From the results of the research that has been carried out, regarding the recognition of individual houses on public burial grounds belonging to the Bandung City government at the Cikadut Public Cemetery and the legal efforts that have been made by the Bandung City government against the detention of houses over public burial grounds. Based on the results of this study, the disturbance of building a house on burial ground can endanger the functional and aesthetic value of Green Open Spaces and housing accommodation on burial ground, including violations and can be subject to sanctions. Abstrak. Peran tanah sebagai salah satu asset negara Indonesia yang sangat mendasar karena negara dan bangsa hidup dan berkembang di atas tanah. Jumlah penduduk dan aktivitas pembangunan di Kota Bandung semakin meningkat. Namun ketersediaan lahan untuk pembangunan semakin terbatas terlebih dalam pembangunan pemukiman sehingga masyarakat banyak yang terpaksa membangun pemukiman di tempat yang tidak seharusnya salah satunya lahan pemakaman di TPU Cikadut Kota Bandung yang beralih fungsi menjadi pemukiman warga. Penelitian ini bertujuan untuk mengetahui terjadinya pendirian rumah di atas tanah tempat pemakaman umum milik pemerintah Kota Bandung di TPU Cikadut dan upaya hukum yang sudah dilakukan Pemerintah Daerah Kota Bandung terhadap pendirian rumah di atas lahan tempat pemakaman umum. Penelitian ini merupakan Penelitian ini merupakan penelitian yuridis normatif dengan menggunakan pendekatan yang menekankan pada norma hukum didasarkan atas kepustakaan dan data sekunder. Spesifikasi penulisan ini adalah deskriptif analitis, yaitu menggambarkan dan menganalisis sendiri dengan memusatkan kepada peraturan perundangan-undangan yang berlaku dikaitkan dengan teori-teori dan pelaksanaan hukum positif. Teknik pengumpulan data penulisan ini adalah studi kepustakaan dan studi lapang dengan wawancara. Metode analisis data penelitian ini adalah normatif-kualitatif. Dari hasil penelitian yang telah dilakukan, terkait pendirian rumah perseorangan di atas tanah pemakaman umum milik pemerintah Kota Bandung di Tempat Pemakaman Umum Cikadut dan upaya hukum yang sudah dilakukan pemerintah daerah Kota Bandung terhadap pendirian rumah di atas tanah tempat pemakaman umum. Berdasarkan hasil penelitian ini akibatnya dari pelanggaran mendirikan rumah dia atas tanah pemakaman dapat membahayakan nilai fungsional dan estetika Ruang Terbuka Hijau dan pendirian rumah di atas tanah pemakaman termasuk pelanggran dan dapat dikenakan sanksi.
One of the government's endeavors to promote legal clarity and maintain communal land rights is to register all land in Indonesia. The Ministry of Agrarian Affairs and Spatial Planning/National Land Agency is in charge of a statewide program called Complete Systematic Land Registration, which aims to speed up the land registration process. In accordance with the directive issued by the Minister of Agriculture and Spatial Planning/National Land Agency Director. A number of problems prevent the implementation of Complete Systematic Land Registration, including inconsistencies in government regulations, the Minister of Agrarian Affairs and Spatial Planning's regulations, and the Law on Regional Taxes and Regional Retributions. Legitimacy Theory, Legal Validity Theory, and Legal Certainty Theory all stipulate that statutory regulations may not conflict with other regulations in order to provide certainty; these theories should be followed if the government is serious about achieving the goal of Complete Systematic Land Registration. Legislation provides safeguards for those with title to land, free of normative conflicts and the potential for multiple interpretations at the administrative and judicial levels. Both the normative legal approach and the synchronization legal approach will be included into the analysis of the qualitative data used in this study.
