The principle of best interest for children requires sanctions of deprivation of liberty as a last resort. Therefore, the principle of the best interests of children must be considered in the resolution of cases of children in conflict with the law. This article, which focuses on the decision of the Tanjung Karang High Court, discusses the functionalization of the best interests principle for children in conflict with the law and the implications of their application. This article concludes, judges in deciding cases of children in conflict with the law in general have not considered the principle of the best interests of the child. Of the 22 cases of children in conflict with the law at the Tanjung Karang High Court, only three decisions that can be categorized have considered the principle of the best interests of the child. Of the three decisions, two were sentenced not prison and one sentenced to prison. The application of the best interest principle for children in conflict with the law can have both positive and negative implications. It has positive implications, especially for offenders, because it protects children’s rights and reduces the burden of court cases and correctional institutions. But it can also have negative implications, because it is feared not to provide a deterrent effect and invite negative public perceptions of the judiciary. Abstrak Asas kepentingan terbaik bagi anak menghendaki sanksi perampasan kemerdekaan sebagai upaya terakhir. Oleh karenanya, asas kepentingan terbaik bagi anak harus menjadi pertimbangan dalam penyelesaian perkara anak yang berkonflik dengan hukum. Artikel ini, yang berfokus pada putusan Pengadilan Tinggi Tanjung Karang, membahas fungsionalisasi asas kepentingan terbaik bagi anak yang berkonflik dengan hukum dan implikasi penerapannya. Artikel ini menyimpulkan, hakim dalam memutus perkara anak yang berkonflik dengan hukum pada umumnya belum mempertimbangkan asas kepentingan terbaik bagi anak. Dari 22 perkara anak yang berkonflik dengan hukum pada Pengadilan Tinggi Tanjung Karang, hanya tiga putusan yang dapat dikategorikan telah mempertimbangkan asas kepentingan terbaik bagi anak. Dari tiga putusan tersebut, dua divonis bukan penjara dan satu divonis penjara. Penerapan asas kepentingan terbaik bagi anak yang berkonflik dengan hukum bisa berimplikasi positif sekaligus negatif. Ia berimplikasi positif terutama bagi pembuat delik, karena melindungi hak-hak anak dan mengurangi beban perkara pengadilan dan lembaga pemasyarakatan. Namun ia juga bisa berimplikasi negatif, karena dikhawatirkan tidak memberikan efek jera dan mengundang persepsi negatif masyarakat terhadap lembaga peradilan.
Abstract Sex is one of the basic human needs and is the basis of marriage. Sex becomes a means of gaining offspring, sexual pleasure, and sexual gratification. Sexual gratification is one of the determining factors in family life. Sexual violence is largely associated with violence against women. In the context of family life as the smallest institution, sexual violence also often occurs. Therefore, it is necessary to be given understanding to the community, especially the PKK drive team in Batanghari Nuban East Lampung District on the importance of prevention efforts on domestic sexual violence to realize resilience Family and country. The effort undertaken in this activity is to provide knowledge and understanding of the law on the prevention of sexual violence in households to the community, especially the PKK Drive team Sub-district Batanghari Nuban East Lampung District. Then proceed with discussion and question and answer, and test participants ' understanding by providing pre test and post test. The results showed that the focus group discussion (FGD) and education activities are important to do to improve the understanding and awareness of public law in preventing household sexual violence. Seks menjadi sarana untuk memperoleh keturunan, kenikmatan seksual, dan kepuasan seksual. Kepuasan seksual merupakan salah satu faktor penentu dalam kehidupan keluarga. Kekerasan seksual pada umumnya sangat berhubungan dengan kekerasan terhadap perempuan. Dalam konteks kehidupan keluarga sebagai institusi terkecil, kekerasan seksual pun acap kali terjadi. Oleh karena itu, perlu diberikan pemahaman kepada masyarakat khususnya Tim Penggerak PKK Kecamatan Batanghari Nuban Kabupaten Lampung Timur mengenai pentingnya upaya pencegahan terhadap kekerasan seksual dalam rumah tangga untuk mewujudkan ketahanan keluarga dan negara. Upaya yang dilakukan dalam kegiatan ini yakni dengan memberikan pengetahuan dan pemahaman hukum tentang pencegahan kekerasan seksual dalam rumah tangga kepada masyarakat khususnya Tim Penggerak PKK Kecamatan Batanghari Nuban Kabupaten Lampung Timur. Kemudian dilanjutkan dengan diskusi dan tanya jawab, serta menguji pemahaman peserta dengan memberikan pre test dan pos test. Hasil kegiatan menunjukan bahwa kegiatan focus group discussion (FGD) dan edukasi ini penting untuk dilakukan guna meningkatkan pengatahuan, pemahaman dan kesadaran hukum masyarakat dalam mencegah kekerasan seksual dalam rumah tangga. Kebijakan dekonsentrasi pengelolaan wilayah pesisir memberikan pekerjaan cukup berat bagi pemerintah Provinsi Lampung yang memiliki 7 (tujuh) kabupaten/kota pesisir dan 132 pulau. Terbatasnya sumber daya manusia, sarana dan prasarana dan jarak Ibu kota provinsi dengan wilayahwilayah pesisircukup jauh menimbulkan tantangan tersendiri dalam pengelolaan wilayah pesisir Lampung, terutama dalam hal pengawasan. oleh karena itu, peran serta masyarakat sangat dibutuhkan guna memaksimalkan pengelolaan wilayah pesisir propinsi tersebut. Penelitian ini bertujuan untuk menggambarkan pemanfaatan pesisir Lampung, mengkaji dan menganalisis kebijakan pengelolaan wilayah pesisir Provinsi Lampung saat ini, dan merumuskan model kebijakan pengelolaan wilayah pesisir Lampung yang berbasis masyarakat. Penelitian ini merupakan penelitian hukum normatif dengan metode analisis deskriptif kualitatif. Berdasarkan hasil penelitian, diketahui bahwa kebijakan pemerintah Provinsi Lampung dalam pengelolaan wilayah pesisir yang direpresentasikan dalam Perda Prov. Lampung No. 1/2018 masih belum memberikan cukup ruang bagi masyarakat untuk berpartisipasi. Adapun model pengelolaan wilayah pesisir berbasis masyarakat yakni menekankan pada pemberdayaan masyarakat dan kearifan lokalnya. Title: Policy Model For Community-Based Lampung Coastal Management PolicyThe shift in the management of coastal areas from decentralization to a policy of deconcentration provides quite heavy work, especially for the Lampung provincial government which has 7 (seven) coastal districts/cities and 132 islands. The limited human resources, facilities, and infrastructure, and the far distance between the provincial capital and coastal areas create challenges in the management of the Lampung coastal areas, especially in terms of supervision. Therefore, community participation is urgently required to maximize the management of the coastal areas of Lampung. This study aims to describe the utilization of the Lampung coastal areas, to analyze the current coastal management policies of Lampung province. In addition, this study also aims to provide and formulate a community-based model of Lampung coastal area management policies. This research is normative legal research with a qualitative descriptive analysis method. Based on the research results, it is known that the Lampung provincial government policy in the management of coastal areas that is represented in the Provincial Regulation of Lampung No. 1/2018 still does not provide enough space for community participation. Meanwhile, the community-based coastal area management model emphasizes community empowerment and local wisdom.
The research aims to analyze the positive and negative implications of the omnibus law on job creation on the development of the forestry sector. In writing, this article is normative juridical. Based on this method, this research is conducted by examining and analyzing theories, doctrines, and laws and regulations that are relevant to the issues discussed. Based on research results, the main points of amendments to regulations in the forestry sector include affirmation of forest areas, forest areas, changes in forest area designation and function, utilization of production forests and protected forests, business permits, non-tax state revenues in the forestry sector, utilization of forest areas outside forestry activities, the authority of the central and regional governments in forest protection, prohibiting activities that cause forest destruction, and imposing sanctions and procedural law on criminal acts of forest destruction. These changes have implications for forest protection in Indonesia, including increasing forest area conversion, limiting community participation in forest management plans, and weakening sanctions (eliminating absolute responsibility). Therefore, in policy formulation, it is necessary to pay attention to forest protection to harmonize human and environmental interests. Based on the results of the research, it is therefore recommended that the government be firm and concrete in regulating forest protection efforts in future implementing regulations.
