Law No. 6 of 2014 concerning Villages provides opportunities for indigenous communities to form indigenous village governments. Nagaris have an established government system, and yet it is getting blurry and dysfunctional institutionally as rules and regulations concerning village governments change. This study aims to explore and rediscover the nagari government models according to the Minangkabau customs. Data were collected with a mixedmethod approach, including survey, observation, interview, and focus group discussion (FGD) methods. This study found that, first, there are two nagari government models in the Minangkabau customs, namely the aristocratic model and the democratic model. Second, the cultural identity of the Minangkabau society is reflected in the concept of banagari, as the traditional system and the government system as an autonomous and independent entity. Third, the nagari government system accommodates two systems that are running simultaneously, namely the state government system and the indigenous government system, in the context of banagari life by using a system that divides the government into three branches, namely an executive, a legislature, and a judiciary.
Industrialization makes people pragmatic and individualistic. The impact can be seen from the estrangement of family relations. Family ties are getting looser because each person is required to have certain duties and professions to fulfill their needs. Social transformation and deregulation make it increasingly difficult to create social intimacy. The purpose of this is to analyze the inequality of the domestic role of the household in litigation, which is more common than talak divorce, as well as social changes in family relations. The method used in this research is qualitative with descriptive approach. The research data was obtained from the results of interviews with the administrators of the Religious Courts and the people of the City/Regency in the Padang Religious High Court Region related to divorce. Other data search techniques are also carried out by means of documentation and observation to the research location. The main objective of this study is to answer one question; How is the transformation from shifting roles between husband and wife to household harmony. That the effect of social transformation on divorce is 1. increasing divorce due to nusyuz: the wife's disobedience to her husband or the wife's lack of rights and obligations. The independence of women is the main factor. 2. Increasing divorce due to shiqaq: husband and wife fighting and arguing with each other. Disharmony is the most common reason put forward by the plaintiffs. The factors that cause divorce is a form of social deviation. This study agrees with the opinion of Emile Durkheim who said that independence in life and economic level as well as the need for social deregulation in the form of deviation.
This study aims to find a network of the phenomenon of the practice of elopement that occurs in the city of Padang. The aim of elopement in this discussion is more intended as an act of institutionalizing elopement in a negative sense, meaning that it violates the rules of religion, the state, and Minangkabau customary provisions which form the cultural locality of West Sumatra Province. The research question that is to be answer are how is the process of forming elopement networks?; what is the service pattern of the practice of elopement?; and what factors trigger the practice of elopement?. Research data obtained from observation, document study and interviews. This study tries to present data and qualitative analysis related to the problem of elopement in the city of Padang, which is the location where the research was conducted. From the research findings, it was concluded that even though it was prohibited by various norms, the existence of elopement services was recognized, the benefits were felt by elements of society, so that it continued to be accepted as a pattern of behavior and action as an alternative to marriage with various variant factors.
