The development and changes of social society is increasingly complex, ranging from social problems, humanities and even legal issues often appear and sometimes make it difficult for the community in determining its status. Therefore, the issue needs intelligence and sharpness of sensitivity or high and sensitive to the situationand conditions, then it be able to reduce the problem of conflict. It takesthinkers and scholars contemporary who are able to provide insight to solve a problem. The maqasid al-syari'ah described abstract although there are already Islamic thinkers who try to explain maqasud al-syari'ah in terms of theory and methodology, but still "grope". This is natural,maqasid al-syariah seeks to change the way of thinking of the classical scholars and still includedthe norms of the basic philosophical values. it is need for further Muslim thinkers to contribute their thoughts of a more systematic maqasid al-syri'ah creation, is a shift paradigm from the old maqasid to the new maqasid. The old maqasid emphasizes on protection (protection) more and perservation.New maqasid emphasizes more on devolopment (development) and righ (right). Welfareof the child's soul protection (hifdzu al-nafs).
Hukum pidana yang paling sering terjadi didalam masyarakat adalah tindak pidana terhadap harta kekayaan (tindak pidana materiil), seperti pencurian, pemerasan, penggelapan, penipuan, pengrusakan, dan penadahan. Adanya penadah sebagai penampung kejahatan pencurian memberikan kemudahan bagi si pelaku untuk memperoleh keuntungan, sehingga pelaku pencurian tidak harus menjual sendiri hasil curiannya ke konsumen tetapi dapat ia salurkan melalui penadah yang berkedok sebagai pedagang. Permasalahan yang timbul itu, baik berupa pelanggaran terhadap norma kehidupan bermasyarakat maupun aturan-aturan hukum untuk menciptakan suatu fenomena yang bertentangan dengan kaidah moral dan kaidah susila serta aturan-aturan hukum. Di dalam Pasal 480 KUHP tentang penadahan jika dipahami dari unsur-unsurnya, yaitu “diharuskan mengetahui atau patut menduga bahwa barang yang diterima adalah hasil kejahatan” sangat membingungkan dan sulit membedakan jika barang yang diterima dari hasil kejahatan itu didapatkan dengan cara-cara yang baik dan tidak menimbulkan kecurigaan apapun, seperti jual beli dengan harga sesuai pada umumnya, dilakukan di tempat ramai dan terang dan cara-cara lain yang tidak patut diduga sebagai kejahatan. (2) Penerima barang hasil kejahatan yang benar-benar tidak tahu dan tidak menduga bahwa barang yang diterimanya adalah hasil kejahatan dengan alasan-alasan yang dapat diterima sebagaimana tersebut di atas dapat dianggap sebagai konsumen yang harus mendapatkan perlindungan hukum sebagaimana yang telah diatur dalam Pasal 4 Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen.Kata kunci: implementasi, penadahan, perlindungan konsumen
This type of research used in this research is normative legal research. By using primary and secondary legal materials, along with tertiary legal materials as supporting materials. According to Article 9 paragraph (2) of Law of the Republic of Indonesia Number 16 of 2001 concerning Foundations (Law 16/2001), the founding deed of a Foundation must be made before a Notary (Notariil) and therefore must be an authentic deed. Deeds of establishment or amendments to the foundation, the articles of association of the foundation must be notarized before a notary public. Considering that the establishment of a foundation has formal requirements, the status of a foundation's legal entity can only be obtained when the deed of establishment is legalized by the Minister of Justice as mentioned in Article 11 paragraph (1). The recognition of the existence of a foundation in a foundation law is motivated by the existence of a legal vacuum and restores the function of the foundation. A foundation is a form of non-profit legal entity in the socio-religious, educational, and related to other social activities. Amendments to the Articles of Association of a Foundation in its establishment are determined by two aspects, First, the aspect of the decision and the aspect of legality.

Knowing whether in the period of iddah which ranges between 3 (three) or four months, the wife in a state of containing or not is an effort to respect religious values even though the reality in the village of Bangkes is not as regulated in Islamic law. As has been found in the rules of the Islamic religion that women who are in the iddah period if the iddah is thalaq qat'ie, the husband has the right to refer it back, but if he wants to marry another man then he must wait until the iddah period is up. Thalaq ba'ien husband is not entitled to refer him back except with a new marriage contract if he has expired his iddah period.
