The aim of the study was to analyses the system of police performance and determine the role of the indicator that shows the number of detected criminal offenses in this system. A comprehensive study of the chosen topic was realized through empirical and theoretical methods, as well as the comparative analysis. It is determined that the components of the system of police performance indicators include the level of public trust in the police as a fundamental indicator that reflects the real state of crime and security in the country; the level of detection of criminal offenses; crime rate and public safety; citizens-police interaction rate; response time to offenses. It was found that the ratio of detected and solved crimes for the reporting period allows reflecting the police performance in the fight against crime, identifying the main problems of organizational, personnel, material, technical and legal nature of their activities. The evaluation of the effectiveness of policing through the prism of detected criminal offenses provides for further research and justification in order to determine effective legal tools for its regulation.
Objective:The purpose of the article was to identify and explore the principal specific crime prevention efforts with a view to controlling criminal offenses in the realm of road transport sector.Methodology: The overriding methodological tools were methods of observation and comparative legal analysis.Resultsandconclusions:The study demonstrated that in order to effectively prevent criminal offenses pertaining to road transport sector, as well as to reduce crime and enhance security, it is expedient to pay attention to the implementation of special crime prevention strategies. Priority areas to be addressed should be efforts to monitor compliance with traffic safety rules, road condition, and technical condition of vehicles. Relevant work should also be carried out to improve the level of "passive safety", as well as to conduct preventive activities for pedestrians, and educational work with professional drivers. Particular attention should be paid to the prevention efforts carried out by investigating agencies, courts and penitentiary bodies.
The aim of the study was to determine the most effective model of legal regulation of the form of declaration of will in legal transactions from the survey of the legislation of several countries and their respective jurisprudence. The research covered the methods of statistical analysis, comparative law, dialectics and legal epistemology, as well as data selection and legal modeling. It is shown that the model of legal regulation of the form of declaration of will, which is based on the principle of free choice of the form of declaration of will, is the most effective in terms of these indicators in the case of: (Greece, Poland, Czech Republic). At the same time, these States provide for strict requirements for challenging legal transactions and provide for the prohibition of abuse of rights. It is concluded that it is justified that in the majority of states the principle of valid will is applied when concluding legal transactions. Moreover, the results of this study can be used to develop proposals for the improvement of legislation in the field of regulation of the forms of declaration of will in the conclusion of legal transactions in their various forms and modalities.
Effective prevention of criminal offences in passenger road transport includes the development and implementation of safer infrastructure and modern modification of the safety features of vehicles. It is important to adopt and enforce legal initiatives to reduce the main risks that entail serious traffic accidents. One of the main priorities of appropriate prevention is to improve legal education of the public. The aim of the article was to consider the current state of prevention of criminal offences in passenger road transport on the territory of Europe. Observation and comparative law were the main methodological tools. The conducted research showed that the EU states apply a variety of approaches to the prevention of criminal offences in automobile passenger transport, such as Vision Zero and the systemic approach Safe System with its Sustainable Safety sub-topic. The need to adopt the experience of Sweden and the Netherlands, which have achieved impressive road safety indicators, in Ukraine seems justified. The eCall traffic accident detection and prevention system and the ESRA innovative prevention method can be examples for implementation in Ukraine. Belgium’s school education program Road Safety Weeks is aimed at minimizing teenage drunk driving, speeding, driver fatigue and distraction. The idea of the programme can be implemented into the relevant preventive activities in Ukraine. A promising vector of further scientific research will be a comparative analysis of the implementation of crime prevention on passenger road transport in the EU countries.
