Abstract. The purpose of this research is to study the main problems that prevent Ukraine from integrating into the global economy and to determine correct focuses of the foreign economic policy of Ukraine against the background of strengthening of globalization tendencies throughout the world. The bases of this research are bases of business development of the foreign economic policy of Ukraine and improvement of Ukrainian economy against the background of international integration. At the heart of the research methodology is a dialectical method of scientific knowledge and, besides, special methods of research based on modern scientific bases of economic, management and related to them knowledge: economic and statistic method -for the assessment of the modern state of foreign trade and investment activity of Ukraine; method of analysis and synthesis -for the determination of tendencies of development of integration processed in Ukraine; comparative analysis -for comparison of information concerning development of specific indicators of foreign economic activities in Ukraine. Results. As a result of research, the main blocks of problems, which impede the integration of Ukraine into the global economy, and requirements for their complex solution are determined. Besides, interdependence and interdetermination of problems, which impede the integration of Ukraine into the global economy, and requirements for their complex solution are explained. Political and legal, economic, sociocultural, and infrastructural preconditions that are necessary for effective integration of Ukraine into the global economy are highlighted. Practical implications. Analysis of the existing problems related to the actual economy, investments, innovation processes gives the possibility to determine the vector of development of Ukraine's economy taking to account recommendations concerning its improvement for the purposes of integration into global economy. Value/Originality. Conducted research has provided the possibility to confirm the obtained results: integration of Ukraine into the global economy is impossible without the development of the main strategic directions of integration, without carrying out reforms that would be helpful in improving Ukraine's reputation on the international stage. It is confirmed that without correct, scientifically well-grounded, carefully well-reasoned and gradually implemented policy in Ukraine, any national strategy of economic and social development that makes provision for integration of our country into global economy cannot be successfully realized.
Ukraine has constitutionally established its European integration aspirations, and therefore ensuring effective and proper legal regulation of property rights to other people's property in the context of updating the civil legislation of Ukraine are important issues. Carrying out reforms in the context of European integration processes is intended to change and improve approaches to both the grounds for acquisition and termination of real property rights. Therefore, it is appropriate to identify trends in their development, taking into account proposals for their reform, since any significant change in this area will inevitably lead to a new quality of legal regulation of the studied relations. Regulation of property rights to other people's property should be carried out taking into account the impact on this sphere of legal relations of the "normative content" of the Association Agreement between Ukraine, on the one hand, and the European Union, the European Atomic Energy Community and their member states, on the other hand. It has been expressed in the article a position on certain aspects of the legal regulation of the acquisition of ownership by acquisitive prescription, servitude, emphyteussis, superficies, acquisition or preservation of property without sufficient legal grounds. The issue of proper legal regulation of forced termination of rem rights to property has become especially relevant in modern conditions. Therefore, special attention has been paid to requisition as a basis for terminating real property rights. The author concluded that the departure from the concept of the absoluteness of property rights was dictated by the change and expansion of the list of property rights, which in the modern period cannot be considered closed. The Civil Code of Ukraine emphasizes that other property rights to other people's property may be established by law. Interpreting this provision, one can come to the conclusion that the list of property rights defined in Art. 395 of the Civil Code of Ukraine is established by law, and not by agreement of the participants in property relations.
The article analyzes the features of such a legal category as easement, namely the concept, content and characteristics of easement as a way of exercising property rights in terms of civil law of Ukraine and formulates proposals for improving the civil law regulation of easement. Emphasis is placed on the study of not only theoretical problems but also issues of a practical nature. The signs of servitude rights, the grounds for private and public interests are investigated. The legal aspects of the servitude are clarified, as well as the individual-normative character is monitored. Positions on concretization of the ratio of the terms «encumbrance» and «restriction» of property rights through the prism of the provisions of easement rights are substantiated. The author clearly concludes that the property right in the form of an easement gives the owner the opportunity to effectively use their property, and also provides the right to satisfy the intangible interests of others whose property right to another’s property is not related to property rights. In the conditions of development and domination of market relations in the society the question of creation of such legal forms which would provide a possibility of a certain participation of one person in the property right of another irrespective of simple personal consent of the last becomes actual. Due to the involvement of land in the civil turnover, the system of easements is a rather complex legal phenomenon. Scientific and theoretical analysis of the construction of easements, methods of their acquisition, the practice of application of relevant legislation indicates the relevance of this institution of property law, especially in the development of land and agrarian reform, the development of legislation on property rights to real estate. Статтю присвячено дослідженню підстав припинення правовідносин за договором про емфітевзис та захисту прав емфітевта. У статті аналізуються характерні риси вказаного договору та характеризуються істотні умови цього договору. Доведено, що договір повинен містити перелік обов’язків землевласника та землекористувача, визначений законодавством. Так, відповідно до вимог цивільного законодавства землекористувач зобов’язаний ефективно використовувати земельну ділянку відповідно до її цільового призначення, підвищувати її родючість, застосовувати природоохоронні технології виробництва, утримуватися від дій, які можуть призвести до погіршення екологічної ситуації. Власник земельної ділянки зобов’язаний не перешкоджати землекористувачеві у здійсненні його прав. Зміст договору емфітевзису є підставою для застосування речових способів захисту щодо третіх осіб, які порушують права титульного землекористувача, і речово-зобов’язальних способів захисту щодо самого власника земельної ділянки. Припинення договору емфітевзису здійснюється у випадках, передбачених законом або договором. Хоча відносини емфітевзису є речовими, проте до відносин, що виникають на підставі договору, застосовуються окремі положення договірного права з урахуванням особливостей речового права. З’ясовано, що перелік підстав припинення права користування земельною ділянкою не є вичерпним, оскільки припинення права користування чужою земельною ділянкою для сільськогосподарських потреб (емфітевзису) можливе за рішенням суду в інших випадках, установлених законом (до прикладу, конфіскація земельної ділянки, визнання недійсним або розірвання договору, використання землі не за цільовим призначенням тощо). Сформульовано низку пропозицій щодо удосконалення норм Цивільного кодексу України, які регулюють право користування чужою земельною ділянкою для сільськогосподарських потреб.
The article is devoted to the study of problematic issues of legal regulation of the nature of relations on the use of another's land (superfitting) in Ukraine. The definition of the concept of "superfidence" and the specific features are analyzed, in particular: may be alienated by the land user or transmitted in the order of inheritance on the basis of a contract or will, the owner of the relevant target destination is not in the right to transfer it under the contract of superficial for the construction of objects that are not Matches its target assignment, superficially contributes to the relevant territorial communities in addition to budget funds. Regarding the right to use another's land plot, it can be established on a defined or indefinite period. A person who has a substance right to someone else's property has the right to protect this right, including from the owner of the property, and is preserved in its change, in accordance with the provisions of civil law. Analyzed, on the example of specific litigation, the need to comply with the provisions of legislation on the procedure and grounds for the transfer of land under the contract of superfiction, without violating the interests of the city's territorial community and the right of co-owners of a residential building. It turned out that the provision of a land plot for the building on the basis of the superfiction is relevant in relations associated with the creation of housing and construction, garage-building, dairy-building, etc. Co-operatives. The author highlights that the provision of the right to use the land does not have the character of personal right law, and accordingly the land contributor - the superficialist can transfer their own rights to use a land to another person. However, the maintenance of the superfiction is required to use a land plot for development taking into account its intended purpose. Specific proposals and recommendations are produced to improve the legal regulation of relations for the use of another's land (superfitting) in Ukraine.
