The subject of this paper is the analysis of knowledge as a subjective element in terms of crimes against humanity in international criminal law. Starting from the fact that committing an act within a widespread or systematic attack against a civilian population is a circumstance that turns a "common" crime into a crime against humanity, the paper seeks to answer the question of whether knowledge of committing an act within such an attack is an independent subjective element and whether there is a unified position regarding the necessary content of knowledge in international criminal law. The paper is based on a linguistic, normative, systematic and comparative legal analysis of relevant provisions of international criminal law sources, a documentary analysis of sample judgments of the three most important international courts, as well as a case study that analyzes this subjective element in the legislation and case law of Bosnia and Herzegovina. The results of the research show that in terms of the independence of knowledge as a subjective element in crimes against humanity, there is a relatively consistent position in international criminal law, while in terms of the content of knowledge there is no such agreement.
Apstrakt: Rad se bavi inkriminacijom prinudnog nestanka lica kao oblikom zločina protiv čovečnosti u Rimskom statutu, izvoru prava koji prvi put precizno određuje biće ovog krivičnog dela. Rad analizira specifičnosti ovog krivičnog dela u pogledu njegove radnje izvršenja koja ima dva stadijuma, subjektivnog elementa koji je kod ovog krivičnog dela dvostruk, učešća države ili političke organizacije kao bitnom elementu bića ovog krivičnog dela ali i zajedničkih elemenata od čijeg ispunjenja zavisi i ispunjenje uslova da bi prinudni nestanak bio zločin protiv čovečnosti. Takođe, rad sadrži analizu vremenske nadležnosti Stalnog međunarodnog suda u pogledu ovog krivičnog dela zbog njegove specifičnosti i u ovom pogledu. Autorka daje prikaz elemenata bića ovog krivičnog dela, nastojeći da ukaže na eventualne probleme koji se mogu pojaviti u praksi kod ovog krivičnog dela, ali i potencijalno preširoka tumačenja na koja možemo naići u literaturi. Pred Evropskim sudom za ljudska prava je u različitim vremenskim periodima razmatrano više predstavki koje se odnose na prinudni nestanak lica iz različitih zemalja. Kao početni problem prilikom razmatranja ovih predstavki javilo se pitanje nadležnosti Suda u vezi sa proceduralnim aspektom čl. 2. Konvencije u predmetima u kojima se nestanak dogodio pre ratifikacije Konvencije, kao i niz drugih pitanja koja se tiču prihvatljivosti iste u skladu sa čl. 34. i 35. Konvencije. Autorka ima za cilj da u ovom radu ponudi pregled i analizu uslova prihvatljivosti i nadležnosti koji su razmatrani u ovim predmetima, odnosno da analizira specifičnosti koje odlikuju postupke pred Sudom u ovim predmetima u ovom segmentu. U tom smislu, ona se u najvećoj meri oslanja na analizu sudske prakse ovog Suda. Pored toga, u radu se daje poseban osvrt na pitanje odbačenih predstavki protiv Bosne i Hercegovine zbog njihove očigledne neosnovanosti.

The paper deals with the principle of legality from the perspective of crime against humanity proceedings in Bosnia and Herzegovina (BiH). During the armed conflict in BiH many war crimes were committed, among all others, a lot of crimes against humanity. In the time when the crimes were committed, a crime against humanity was not prescribed by the in effect criminal code. Despite that fact, criminal courts in BiH convicted numerous offenders for crimes against humanity on the basis of its prescription in international law. That led the author to the question: what was the path of crime against humanity proceedings in BiH? In the first part of the paper, the author gives an overview on the matter of jurisdiction for crime against humanity in BiH and position of principle of legality in the BiH legal system. That part also contains the insight into the main characteristics of the principle of legality's understanding in different legal traditions, but also the insight into this principle understanding in the international (criminal) law. In the second part, the author analyses Court of BiH's judgments in order to find out what was the source of law used by this court for its crime against humanity convictions. Thereafter, the author analyses Constitutional Court of BiH's decisions related to the alleged breach of BH Constitution and ECHR in relation to the principle of legality regarding crime against humanity proceedings. At the end, the paper gives the overview of ECtHR case law related to the crime against humanity proceedings in BiH - Šimšić v. BiH and Maktouf and Damjanović v. BiH cases. In the last part, the author, taking into consideration understanding the principle of legality in BiH legal tradition, presents the main conceptual problems that were raised from the crime against humanity proceedings in BiH.
