Assurance of proper and good job is one of indicators of the success of the State to run the constitution in accordance with the mandate of the Constitution of the Republic of Indonesia. In the era of free trade and economic society, work is a problem that is less of a concern for the state because there is no comprehensive protection. Even in the year 2003 was born a law on employment, at the beginning of the law establishment, a lot of optimism that of the Indonesian population especially workers who have been unprotected related to the rights of workers. But over time, many problems arise in the community one of them is the guarantee of continued work for outsourcing workers, so a thorough legal review of employment protection guarantees is shifted to its work.
This study seeks to examine the model of government accountability for protecting Indonesian migrant workers in China. The expected goal of this research is to make a positive contribution to the legal protection system for Indonesian migrant workers in China that is in harmony with justice and can create a sense of peace and security for Indonesian migrant workers in China. This research was carried out with an empirical juridical approach by analyzing primary data by searching for data by going directly to the field and then analyzing it with legal materials, especially primary legal materials and secondary legal materials. Data observation will be carried out using field studies connected with the subject matter studied. The findings and novelties in this study indicate that migrant workers are often objects of human rights violations, such as not getting guaranteed rights and placements when the migrant workers go abroad through illegal labor suppliers. Especially in this case, the crew from Indonesia works on the Chinese ship, the Longxing Ship. This study concludes that problems related to migrant workers must get full attention and protection from the Government because it concerns the safety of Indonesian citizens. Therefore, in this case, the Tegal Regency Manpower and Transmigration Office, the Government must provide full protection to Indonesian migrant workers. In particular are crew members from Indonesia who work on Chinese ships.
The State Administrative Court (PTUN) is a place to find the real truth about the actions of state administrative officials that are not under the General Principles of Good Governance (AAUPB), for people whose interests and rights are taken away by parties who are deemed to be acting arbitrarily against other parties. The decisions that have been produced during the proceedings at the PTUN will undoubtedly have an impact which is expected to make a positive contribution in formulating a system of legal protection that is just, harmonious, and under the State Administrative Court Law and the 1945 Constitution of the Republic of Indonesia as the basis of the Indonesian state.

Penelitian ini berusaha mengkaji mengenai penerapan pola sanksi yang didapat oleh perusahaan penyedia jasa tenaga kerja sebagai buruh migran dan perlindungan bagi buruh migran Indonesia. Penelitian dilakukan dengan menggunakan pendekatan yuridis empiris dimana realita yang terjadi dilapangan dikaji dan dikomparasi dengan ketentuan hukum yang berlaku. Tujuan untuk mengetahui seperti apa perlindungan hukum bagi pekerja migran dan sanksi bagi Penyedia Jasa Tenaga Kerja Indonesia
Lahirnya positivisme merupakan langkah awal dari modernisasi karena mundurnya pengaruh agama dan raja sebagai wakil Tuhan. Era renaissance membuat manusia bukan hanya percaya pada Hukum Tuhan semata. Pola berfikir positivisme yang mengandalkan empirisme filosofis mulai dibawa masuk ke wilayah hukum pada abad ke-19, dimana positivisme mengedepankan adanya kepastian hukum dengan mengambil sumber hukum formal berupa peraturan perundang-undangan. Tidak selamanya positivisme hukum mengabaikan moral begitu saja, ia masih terbuka untuk perbaikan menjadi yang lebih baik namun tetap diperlukan prosedur yang berlaku. Namun apa yang dianggap kebaikan oleh positivisme hukum itulah keburukan dari positivisme hukum ini. Positivisme yang mempunyai aspek ontologis dalam positivisme yang dianggap sebagai norma positif dalam sistem perundang-undangan suatu negara sehingga terlepas dari masalah moral. Di sisi lain, implikasi dari positivisme terhadap hukum dan penegakkannya adalah dipakainya hukum sebagai alat untuk mempertahankan kekuasaan pemerintah untuk terus membuat kedudukan itu menjadi langgeng dan abadi
