Balu sering dibeban tanggungjawab mendidik, menafkah dan memberi kasih-sayang kepada anak-anaknya yang berstatus yatim secara bersendirian. Ini adalah isu agama dan kemanusiaan yang perlu diberi perhatian serius. Justeru kajian ini bertujuan bagi mengenal pasti mekanisme perlindungan ibu tunggal dan anak yatim menurut syariat Islam. Data dikumpul dari sumber pustaka dengan memberi fokus terhadap hukum-hakam berkaitan nafaqat yang dianalisis semula secara holistik; iaitu dengan mengaitkannya dengan bab-bab lain seperti wilayat al-nikah dan faraid, selain melihat kepada tafsīr ayat-ayat berkenaan dan hadis-hadis lain yang menyentuh perihal ibu tunggal dan anak yatim pada zaman Nabi SAW sama ada dalam bentuk instruktif atau diskriptif. Hasil kajian mendapati ibu tunggal yang mengalami situasi tersebut sepatutnya dikecualikan daripada beban nafkah. Nafkah anak-anaknya hendaklah ditanggung oleh walinya atau penerima harta pusaka ayahnya menurut turutan asabah. Selain itu, Islam juga menggalakkan masyarakat membantu menjaga golongan ibu tunggal dan anak yatim ini dengan beberapa cara lain. Abstract Widows are often burdened with the responsibility of educating, supporting and giving love to their orphaned children, all by themselves. This is a religion and humanity issue that needs serious attention. Therefore, this study aims to identify the protective mechanism of single mothers and orphans according to Islamic law. Data were collected from library sources with a focus on holistically re-analyzed nafaqat laws; that is, by relating it to other laws such as wilayat al-nikah and faraid, while closely observing the tafsīr of the Qur’anic verses and hadiths pertaining to the treatment received by single mothers and orphans, either in an instructive or descriptive form. The study found that single mothers who experience the situation should be exempted from the financial burden in raising her orphaned children. The alimony of her orphaned children should be borne by the children’s guardian or the heir of their father, according to inheritance law and order. Apart from that, Islam also encourages the community to help take care of these single mothers and orphans in several other ways. Keywords: alimony, single mother, orphan, guardian, inheritance
The development of science oftafsÊr and hadÊth in Malaysia is quite advanced. However both are not formally established as a discipline of science. The discussion is more towards the science of tafsÊr and hadÊth commentary itself rather than studying the problems in society and its solutions from the perspective of Qur'an and Sunnah. Employing qualitative method, this paper aims at studying the experience of Malaysia in the development of science of tafsÊr and hadÊthstudies, the historical overview and its impact towards educational system and other Islamic instutions, such as Shariah judicial and financial system. The paper also seeks to identify the challenges and obstacles that might have hindered the progress of developing a more integrated methodology of science of tafsÊr and hadÊth studies that may offer practical solutions to address the current religious, socio-political and economic problems facing the Muslim society from the Qur'an and hadÊth perspectives. n Malaysian Educational i th i Had nd a r i 'Ilm Tafs f o The Development System Abstrak Pembangunan ilmu tafsir dan hadis begitu maju ke hadapan dalam konteks Malaysia. Perbincangan tafsir dan hadis lebih fokus kepada penilaian dan perbincangan isi kandungannya daripada menawarkan solusi kepada masalah masyarakat yang perlu diselesaikan. Kajian ini menggunakan kaedah kualitatif dalam menganalisis perkembangan serta latar belakang ilmu tafsir dan hadis dan kesannya terhadap sistem pendidikan dan institusi Islam seperti Mahkamah Syariah dan sistem kewangan. Kajian ini cuba untuk mengenal pasti cabaran yang mungkin membantut perjalanan ilmu tafsir dan hadis dalam meneliti kaedah yang lebih tepat untuk mencari jawapan yang praktikal dalam menangani isu agama, sosio-politik dan masalah ekonomi dalam kalangan Muslim. Islam permits polygamy to preserve woman’s dignity and cares for the social moral and economic wellbeing of wives and orphans. Unfortunately, a number polygamous marriage among Muslims in Malaysia is dramatically misleading from both Islamic theories as well as principles. Hence, it has become a very controversial issue among its critics and supporters which resulting in serious criticism on the credibility of Islamic Family Law Act 1984.(ILLA) As a short term measure, a reform the IFLA has been suggested to focus more on specific legal mechanisms in curbing abuse of polygamy. In this paper the author attempts to analyze the synchronization of the IFLA in the light of Qur’an and Sunnah in order to suggest more effective, practical, and acceptable solutions in overcoming the issues and complying with the requirements by ‘following the real teaching in the revelation.’
