Mazhab sejarah merupakan mazhab dalam filsafat hukum yang sangat penting dalam perkembangan filsafat hukum. Konsepsinya yang mengedepankan jiwa bangsa (volkgeis), dengan ungkapan yang dikemukakan Von Savigny "das recht wird nicht gemacht, est ist und wird mit dem volke", yang mengandung arti "hukum itu tidak dibuat, tetapi tumbuh dan berkembang bersama masyarakat". Konsepsi ini sangat berpengaruh bagi perumusan konsep hukum tidak hanya di Jerman, tetapi sudah meluas ke luar Jerman termasuk Indonesia.Kelebihan konsepsi mazhab sejarah ini mampu memandang bahwa hukum-hukum yang berasal dari masa lalu merupakan hukum yang pernah dijalankan di masa lalu, dan sedikit banyak akan mempengaruhi hukum yang berlaku di masa sekarang, karena jiwa bangsa (volkgeist), sesuai dengan jiwa masyarakatnya yang merupakan sumber dari segala hukum yang tumbuh dan berkembang dalam masyarakat tersebut dari waktu ke waktu dan dari masa ke masa. Filsuf-filsuf yang lahir dan menjadi pelopor bagi mazhab sejarah ini mendasarkan pemikirannya bahwa hukum terbentuk di luar legislasi, artinya hukum tidak dibuat oleh lembaga formal, tetapi tumbuh dan berkembang di masyarakat secara alami.Kata kunci : Mazhab Sejarah, Jiwa Bangsa (Volkgeist), Filsafat Hukum. Abstrak The historical school is a school in legal philosophy which is very important in the development of legal philosophy. The concept is the soul of the nation (volkgeis), with the phrase put forward by Von Savigny "das recht wird nicht gemacht, est ist und wird mit dem volke", which means "law is not made, but grows and develops with the community". This conception is very influential for the formulation of legal concepts not only in Germany, but also outside Germany, including Indonesia. The advantage of this historical school of thought is that it is able to view that laws originating from the past are laws that have been implemented in the past, and will more or less affect the laws that apply in the present, because the spirit of the nation (volkgeist), is in accordance with the soul of the people who are the source of all laws that grow and develop in the community from time to time and from time to time. Philosophers who were born and became pioneers for this school of history based their thinking that law is formed outside of legislation, meaning that law is not made by formal institutions, but grows and develops in society naturally.

The purpose of this legal research is to explain the first discussion, namely how to implement law enforcement against criminal conspiracy (samenspanning) which has been regulated in the Criminal Code and the Criminal Procedure Code. Second How is the imposition of sanctions for criminal conspiracy charges regulated in the Criminal Code in case Number: 293K / Pid / 2016. This type of research is normative research which is descriptive-analytical in nature, using secondary data with data collection techniques through library research and processing data qualitatively, it is concluded that law enforcement against criminal conspiracy is carried out by penal measures, penal measures are one of the efforts to enforce the law or all actions taken by law enforcement officials that focus more on eradication after a crime is committed under criminal law, namely criminal sanctions which constitute a threat to the perpetrator. The stages in this way include investigation, further investigation, prosecution, and so on, which in this case is part of criminal politics. The functionalization of criminal law is an effort to tackle crime through rational criminal law enforcement with the aim of creating the fulfillment of a sense of justice and efficiency. The imposition of sanctions Criminal sanctions imposed if a person has been proven to have committed a criminal act of treason can be punished with a criminal sentence contained in Article 106 of the Criminal Code with the threat of life imprisonment or twenty years in prison.

Abstrak Tujuan untuk dilakukannya penelitian ini ialah untuk menjabarkan bahwa Pancasila sebagai ideologi bangsa Indonesia, pada hakikatnya adalah suatu refleksi kebangsaan Indonesia, yang terlahir dari bangsa yang memiliki kegemilangan di masa lampau dan menjadi pusaka bagi generasi selanjutnya sepanjang masa. Pancasila sebagai ideologi bangsa Indonesia mengandung makna yang holistik dan mendalam, tidak hanya sebagai dasar atau landasan dari bangsa dan negara Indonesia, tetapi lebih jauh dari itu ideologi bangsa Indonesia pada hakikatnya adalah tujuan hakiki dari bangsa yang memiliki berbagai dimensi untuk mencapai tujuan yang paripurna. Metode yang dipakai dalam penelitian ini ialah dengan pendekatan yuridis normatif ditujukan pada penelitian kepustakaan. Tujuan paripurna yang hendak dicapai itu tidak lain yaitu terwujudnya Bangsa dan Negara Indonesia yang adil dan makmur tidak hanya slogan, moto, atau simbolis apalagi suatu mimpi yang tak bertepi sehingga menjadi ilusi, tetapi tujuan yang memang seharusnya diperjuangkan oleh semua elemen bangsa sebagai suatu keniscayaan.  Kata kunci : Ideologi, Pancasila, Bangsa Indonesia. Abstract The purpose of this research is to describe that Pancasila as the ideology of the Indonesian nation is, in essence, a reflection of the Indonesian nationality, which was born from a nation that had glorious past and became an heirloom for future generations throughout the ages. Pancasila as the ideology of the Indonesian nation contains a holistic and deep meaning, not only as the basis or foundation of the Indonesian nation and state, but further than that the ideology of the Indonesian nation is essentially the ultimate goal of a nation that has various dimensions to achieve a plenary goal. The method used in this research is a normative juridical approach aimed at library research. The plenary goal to be achieved is none other than the realization of a just and prosperous Indonesian Nation and State, not only a slogan, motto, or symbol, let alone an endless dream so that it becomes an illusion, but a goal that all elements of the nation should strive for as a necessity. Keywords: Ideology, Pancasila, Indonesian Nation.
