The provision of legal aid to persons with disabilities in the judicial process often faces obstacles. They have lost the right to obtain justice due to the unfulfilled reasonable accommodation for persons with disabilities. This study aims to find the provision of legal aid to persons with disabilities in the judicial process that is appropriate to the reasonable accommodation for persons with disabilities in the judicial process. The study is empirical research with depth analysis of legal aid practice with reasonable accommodations. This research is empirical to research the handling of persons with disabilities facing the law by legal aid providers. Research on reasonable accommodation for persons with disabilities has been widely carried out. However, the research related to the provision of legal aid following reasonable accommodation has never existed. Therefore, this study is expected to improve the condition of legal assistance to persons with disabilities. The provision of legal aid without considering reasonable accommodation creates obstacles to the resolution of the case. This study concluded that removing obstacles and providing legal assistance were carried out following reasonable accommodation by knowing the needs of disability, such as the needs of disability assistants and translators, legal, health, and psychosocial needs, recovery, and reintegration. The results of this study can be a guideline for advocates or legal aid institutions in providing legal assistance for persons with disabilities.
Settlement of Sharia economic disputes can be taken in two ways, namely litigation and non-litigation. Non-litigation dispute resolution can be done by cooperating with third parties. This has been implemented in resolving sharia economic disputes at KSPPS Khodijah Pedan against the bad financing of customers who have loans of less than Rp. 10,000,000,-(Ten Million Rupiah) on the condition that they are UMKM actors. In this case, KSPPS Khodijah has given power to the Law and Human Rights Council of PWA Central Java as a legal representative and normalization team. In its efforts to reduce customer bad debts in KSPPS Khodijah, the Law and Human Rights Council of PWA Central Java has collaborated with a third party, namely Baznas of the Republic of Indonesia, to provide an injection of funds from zakat to mustahik UMKM actors who have debts in KSPPS Khodijah Pedan Klaten. This research is a field research and to achieve this goal the author uses a qualitative approach that is descriptive. In this study, the primary data used were generated from interviews. The interview was conducted with KSPPS Manager Khodijah Pedan, The Assistance Team, Baznas Managers, and the Community who received assistance from Baznas. Meanwhile, secondary data is obtained from books, journals and related laws and regulations. The results showed that this kind of dispute resolution model is considered very effective because it is able to provide solutions for customer finances which are also mandatory. This is evidenced by the increase in the amount of mustahik income of UMKM actors from before and after receiving zakat fund assistance from Baznas. And customers/mustahiks in the bad debt category can pay off their debts at KSPPS Khodijah Pedan.
Artikel ini mengurai masalah anak. Dimana anak merupakan faktor terpenting dalam proses maju mundurnya suatu Negara. Problem anak sangatlah kompleks, di antaranya; kekerasan, kesehatan, diskriminasi, anak berhadapan dengan hukum, eksploitasi, perdagangan anak, pekerjaan terburuk buat anak, anak korban konflik, subordinasi dan lain-lain. Upaya pendampingan dan advokasi menjadi cara penyelesaian masalah anak berhadapan hukum.
This research is about the practice of fulfilling the rights and obligations of disabled marriages in the Association of Persons with Disabilities in Klaten Regency in the perspective of the Compilation of Islamic Law and Gender Analysis. This research is motivated because First, in the PPDK Institution there are a number of people with disabilities from various crosses of people with disabilities, both blind, physically handicapped, and visually impaired. Second, the PPDK Institute oversees several organizations including the Indonesian Blind Association of the Klaten District, the Indonesian Muslim Blind Association in Klaten Regency, the Klaten Blind Association, and the Klaten Deaf Association. The purpose of this study is to describe the practice of fulfilling the rights and obligations of disability marriages in the PPDK Institution. This type of research is a type of field research using a qualitative research approach. The types of data used are primary and secondary data types. Methods of data collection using interviews and documentation. The data analysis technique used is the analysis of Milles and Huberman. The results of the study indicate that in practice the fulfillment of rights and obligations has various patterns. The efforts made by persons with disabilities do not violate the values in KHI. Even if it is seen from the gender analysis, the wives still experience multiple roles in their practice of life. However, all these efforts are done sincerely for the sake of realizing a sakinah household, mawaddah warohmah. Abstrak Penelitian ini mengenai praktek pemenuhan hak dan kewajiban perkawinan disabilitas di Lembaga Perkumpulan Penyandang Disabilitas Kabupaten Klaten dalam perspektif Kompilasi Hukum Islam dan Analisis Gender. Penelitian ini dilatarbelakangi karena Pertama, di Lembaga PPDK terdapat jumlah penyandang disabilitas dari berbagai lintas penyandang disabilitas baik disabilitas tuna netra, tunadaksa, tuna ruwi. Kedua, di Lembaga PPDK ini membawahi beberapa organisasi diantaranya Persatuan Tunanetra Indonesia Cabang Kabupaten Klaten, Ikatan Tunanetra Muslim Indonesia Kabupaten Klaten, Ikatan Tunadaksa Klaten, Persatuan Tunarungu Klaten. Tujuan dari penelitian ini yaitu untuk mendiskripsikan praktek pemenuhan hak dan kewajiban perkawinan disabilitas di Lembaga PPDK. Jenis penelitian ini merupakan jenis penelitian lapangan (field research) dengan menggunakan metode pendekatan penelitian kualitatif. Jenis data yang digunakan yakni jenis data primer dan sekunder. Metode pengambilan data menggunakan wawancara dan dokumentasi. Teknik analisis data yang digunakan yaitu analisis Milles dan Huberman. Hasil dari penelitian menunjukkan bahwa penyandang disabilitas tersebut dalam praktek pemenuhan hak dan kewajiban mempunyai beragam pola. Upaya yang dilakukan para penyandang disabilitas tersebut, tidak menyalahi nilai-nilai dalam KHI. Meskipun jika dilihat dari analisis gender para isteri masih mengalami peran ganda dalam praktek kehidupannya. Namun semua usaha tersebut dilakukan ikhlas semata demi terwujudnya rumah tangga sakinah, mawadah warohmah.
Accessibility of education for people with disabilities has been guaranteed by Law no. 18 of 2016 concerning Persons with Disabilities. However, there is still a lot of data that shows that many children with disabilities do not have access to education, especially children with disabilities who are victims of violence, where in addition to having obstacles to their disabling condition, they also experience deep trauma but the trauma is not immediately known. This study will describe the barriers that occur for children with disabilities in getting access to education widely and what efforts can be made to fulfill the accessibility of education for them. This research methodology uses a qualitative and descriptive-analytical approach by taking the research location at the Aisyiyah Regional Leadership Council of Law and Human Rights, Central Java, which mainly assists children with disabilities who are victims of violence. In this study, it was found that there were obstacles experienced by children with disabilities in getting access to education, from the various obstacles that can be grouped into, barriers that come from parents, the community, government officials, educational institutions, and the children with disabilities themselves. and the efforts made to fulfill the accessibility of education for children with disabilities, namely consultation, investigation, profile assessment, physical healing, psychological healing, advocacy, home visits, psychological counseling, spiritual strengthening, and providing assistance. Aksesibilitas pendidikan bagi difabel telah dijamin oleh UU No. 18 Tahun 2016 tentang Penyandang Disabilitas. Namun, masih banyak data yang menunjukkan banyak anak difabel tidak mendapatkan akses pendidikan apalagi anak difabel korban kekerasan, dimana selain mereka memiliki hambatan terhadap kondisi difabelnya itu sendiri juga mengalami traumatik yang mendalam tetapi tidak serta merta diketahui traumanya. Penelitian ini akan memaparkan hambatan-hambatan yang terjadi bagi anak difabel dalam mendapatkan aksesibilitas pendidikan secara luas dan upaya apa yang dapat dilakukan untuk pemenuhan asksesibilitas pendidikan bagi mereka. Metodologi penelitian ini menggunakan pendekatan kualitatif dan bersifat deskriptif analitis dengan mengambil lokasi penelitian di Majelis Hukum dan HAM Pimpinan Wilayah ‘Aisyiyah Jawa Tengah yang banyak melakukan pendampingan terhadap anak difabel korban kekerasan. Dalam penelitian ini ditemukan adanya hambatan yang dialami anak difabel dalam mendapatkan akses pendidikan, dari berbagai hambatan tersebut dapat dikelompokkan menjadi, hambatan yang berasal dari orang tua, masyarakat, aparat pemerintah, lembaga pendidikan, dan dari diri anak difabel sendiri. dan upaya yang dilakukan untuk pemenuhan aksesibilitas pendidikan bagi anak difabel , yaitu konsultasi, investigasi, profile assesment, penyembuhan fisik, penyembuhan psikis, advokasi, home visit, konseling psikologi, penguatan spiritual, pemberian bantuan.
