Pancasila menjadi sumber dari segala sumber hukum yang menjadi penuntun hukum. Posisi Pancasila sebagai dasar dan ideologi negara, serta dasar filosofis negara Republik menegaskan bahwa setiap materi muatan peraturan perundang-undangan tidak boleh bertentangan dengan nilai-nilai yang terkandung dalam Pancasila. Berdasarkan Undang-Undang Nomor 12 Tahun 2011 dan Undang-Undang Nomor 15 Tahun 2019 Tentang Perubahan Undang-Undang Nomor 12 Tahun 2011 Tentang Pembentukan Peraturan Perundang-undangan, menentukan bahwa Peraturan Gubernur juga merupakan peraturan perundang-undangan. Peraturan Gubernur Jawa Timur Nomor 4 Tahun 2018 Tentang Perubahan Atas Peraturan Gubernur Jawa Timur Nomor 88 Tahun 2017 Tentang Pedoman Umum Pengelolaan Dana Bergulir Provinsi Jawa Timur adalah kebijakan yang dikeluarkan sebagai dasar pelaksanaan penggunaan anggaran pendapatan dan belanja daerah (APBD) untuk memberikan modal kerja dan investasi kepada masyarakat Jawa Timur agar dapat memenuhi prinsip-prinsip pengelolaan keuangan sesuai ketentuan dan norma yang berlaku. Dana bergulir modal kerja dan investasi Pemerintah Provinsi Jawa Timur disebutkan menjadi penggerak roda perekonomian Jawa Timur. Kebijakan dibidang ekonomi yang diwujudkan dalam bentuk Peraturan Gubernur tidak cukup hanya dinilai atau digunakan sebagai dasar hukum atau legitimasi yang dapat dipertanggungjawabkan terkait pengalokasian penggunaan APBD, namun juga harus dianalisis norma atau substansi Peraturan Gubernur tersebut apakah telah sesuai dengan nilai-nilai Pancasila dan juga asas-asas pembentukan peraturan perundang-undangan sebagimana yang diatur dalam Undang-Undang Nomor 12 Tahun 2011 dan Undang-Undang Nomor 15 Tahun 2019 Tentang Perubahan Undang-Undang Nomor 12 Tahun 2011 Tentang Pembentukan Peraturan Perundang-undangan.
The Covid-19 pandemic is interpreted by the President as a public health emergency (KEPPRES No. 12 of 2020). None of those declarations refers to either Article 12 or Article 22 of the 1945 Constitution of the Republic of Indonesia, although the situation (de facto) meets all the criteria of a state of emergency. On behalf of justice, normal law shall be applied in a normal situation, while in an abnormal situation, an abnormal law shall be applied. Regarding that issue, this paper investigates these three questions: i) why is the state of emergency not applied in the time of Covid-19? ii) how to measure the scale of the emergency of Covid-19 pandemic from the perspective of the state of emergency? iii) how should the law of the state of emergency in Indonesia overcome the situation in the future? These questions would be discussed on the level of legal philosophy using legal politics approach, statutory approach, conceptual approach, theoretical approach, and comparative approach. The main principle is solus populi suprema lex. It should be implemented properly. The results of this study indicate and explain that the state emergency law must adhere to the concept of people’s security is state security. In addition, state emergency laws must be anticipatory to new and very diverse developments and forms of danger. In Indonesia, this year President has issued a controversial regulation, Presidential Regulation (PERPRES) No. 20 of 2018 on Foreign Workers. The purpose of this paper is to analysis that regulation from the administrative law perspective. In fact, it is suspected as bad regulation for Indonesian workers. By doing a juridical review, using literature study as the research method, this paper would explain how it should be regulated; and how it should be implemented in free trade era to guarantee the prosperity as written in The Preamble of UUD NRI 1945. Based on this regulation, IMTA, that should be used by the government to prevent domination of foreign workers, has been shifted to RPTKA. But, RPTKA is not a license. It is only an optional requirement. PERPRES No. 20 of 2018 is contradictive with the principles and the purpose of UU No. 13 of 2003 on Labor Act, and Act No, 25 of 2007 on Investment Act itself.
