In contrast to the documents of the USSR, in which the term «law enforcement agencies» was used rather fragmentarily, in the legislation of the Russian Federation this term is used quite widely.
At the same time, there is no definition of the term “law enforcement agencies” in the legislation of the Russian Federation, and in the context of the provisions of certain regulatory legal acts, this term is given a different meaning. The list of law enforcement agencies of the Russian Federation is also not legally fixed. The current situation has a negative impact on the uniform application of certain provisions of the legislation and leads to an unreasonably wide discussion on this issue.
In the article, based on the analysis of the norms of the legislation of the Russian Federation on public service, the authors argue that the positions of the federal public service of other types (positions of the federal public service related to law enforcement) are currently introduced in nine federal state bodies and, accordingly, the actual presence in The Russian Federation has just such a large number of law enforcement agencies.
In order to resolve the situation described in the article, the authors conclude that it is necessary to adopt a single legislative act regulating the procedure for passing the law enforcement service, in which, among other norms, it should be expressly fixed that the list of law enforcement agencies is approved by the President of the Russian Federation.
