This paper aims at explaining the background of the persistence of Pulang ka Bako marriage in Lasi area and its correlation to family resilience. This research is field research. The Minangkabaunese still carry out the tradition of Pulang ka Bako marriage (marrying the daughter of father’s female sibling) in Minangkabau community, especially in Lasi area. This marriage is considered the ideal type of marriage in Minangkabau. The data sources were obtained from the result of interview with married couples, traditional leaders, and religious leaders. The collected data were then reduced, presented, and concluded. This result showed that the background of Pulang ka Bako marriage was the community’s understanding that this type of marriage can guarantee the development and maintenance of inheritance, kinship social relations, and preservation of traditions and customs. This tradition can build family resilience in the terms of economic and social, and it strengthens cultural resilience as well. From the perspective of maqashid al-sharia, Pulang ka Bako marriage does not only bring benefit to the individual but also to the family. Besides fulfilling the elements of hifzun nasl (preserving offspring), hifzul mal (managing assets), and hifzul 'irdh (maintaining honor), Pulang ka Bako also fulfills the elements of tahqiqul sakn wal mawaddah wa rahmah (realizing the sense of peace, love, and compassion) and tanzimul janibul mali (managing family finances). It can be concluded that Pulang ka Bako type of marriage has fulfilled the objectives of Islamic law and is capable of being one of the solutions to family resilience issues.
This study examines the review of muamalah fiqh on the practice of paying basiang padi with the indak dilpaesi system in Jorong Balimbing. The purpose of this study was to identify and explain the practice of paying basiang padi with an uncoated system, as well as to explain a review of muamalah fiqh on the practice of paying basiang padi with an uncoated system in Jorong Balimbing, Nagari Balimbing. The research method used is a qualitative research method by conducting field research with observation and interview data collection techniques. The research finding is that the wage practice of paying basiang padi with the indak dilapesi system in Jorong Balimbing is done by paying part of the agreed wage, which is given wages to cultivators as much as 4 liters of rice while wages should be paid 6 liters of rice. Based on the principle of fairness, wages for basiang padi with the indak dilapesi system are not in accordance with the pillars and conditions of wages. There is an element of injustice in delaying the payment of wages and reducing the payment of wages to the detriment of one party, this is not allowed in muamalah fiqh.
Studi ini mengkaji tentang kesesuaian foto produk dengan wujud aslinya dalam jualan online di platform Lazada. Permasalahannya adalah cideranya unsur kerelaan dalam akad jual beli ketika barang yang diterima oleh pemesan tidak sesuai dengan wujud aslinya. Dari permasalahan ini muncul pertanyaan penelitian bagaimana bentuk-bentuk inkonsistensi foto pruduk dengan wujud aslinya di platform Lazada dan bagaimana tinjauan hukum Islam terhadap inkonsistensi antara foto produk dengan wujud asli tersebut? Penelitian ini adalah penelitian lapangan (field research), dalam bentuk data penelitian kualitatif, dengan pendekatan observasi dan dokumentasi. Analisis data disajikan dengan naratif kualitatif, dikaitkan dengan data-data ynag relevan dengan tema yang diteliti, sehingga kevalidan ditemukan melalui perbandingan antara satu sumber dengan sumber yang lain untuk tema yang sama. Hasil penelitian bahwa kasus ketidaksesuaian foto gambar dan wujud asli produk dalam jualan online di platform Lazada pada segmentasi pakaian itu terjadi real bukan hanya hipotesa peneliti saja. Terjadi feedback keluhan konsumen kepada para penjual di platform Lazada dari mulai keluhan adanya ketidaksesuaian ukuran, warna, bentuk, dan bahan yang berbeda dengan yang ada di deskripsi foto gambar. Transaksi yang terjadi dalam jual beli online secara keseluruhan sudah memenuhi syarat sahnya jual beli online, tetapi transaksi jual beli online yang terjadi di platform Lazada pada segmentasi pakaian tidak sah karena adanya syarat sah jual beli yang tidak terpenuhi dalam syarat benda yang diperjual belikan (muslam fiih).
