The study of Usul Fiqh only feels essential when it deals with different problems whose orders it executes not involve in the offer of the old Fiqh. Besides that, with the rising number of participants of comparative school legislation alike to discover out which idea is more powerful, since closely as the effort to transform Islamic rule, it will increase appeared in how urgent the role of Ushul Fiqh is. The paper tries to present this discussion to suggest the relevance of this idea of Fiqh in dealing with legal issues dealt with by Muslims who sometimes put on nonessential issues. The author organized research with a comparative descriptive analysis. This study organized a view of the works of Usul Fiqh along with the rules contained there in along with the development of Usul Fiqh and its benefits from time to time. The authors identify that Ushul Fiqh plays a highly considerable position in the improvement of Islamic law. Not merely that, Usul Fiqh, the essential function of Usul Fiqh, is to improve someone to find out the rules they take based on syar'i arguments, so that they do not rely very often on considering other people whose bases they do not have. There are not a few obstacles in the Islamic world community with the presence of discoveries by scientists who require answers and confidence of Islamic law.
Ijtihad sebagai fondasi kebangkitan dan kemajuan umat Islam jadi terpinggirkan akibat salah paham terhadap spirit ajaran Islam yang dibawa Rasulullah. Menurut Ameer Ali, Ijtihad upaya yang ampuh mewujudkan kebangkitkan Islam kembali. Jika di Eropa Renesans didorong oleh lahirnya gerakan Reformasi, dengan menyingkirkannya belenggu Ecclesiastisisme, maka dalam Islam, pembaharuan (reform) harus didahului oleh gerakan pencerahan (enlightenment). Untuk mewujudkan berperannya kembali ijtihad harus dilakukan dua hal; Pertama, membebaskan umat dari belenggu pemahaman literal terhadap sumber-sumber pokok ajaran Islam. Kedua, membebaskan umat dari doktrin „keseragaman‟ yang dibentuk oleh forma-lisasi dan institusio-nalisasi paham agama, yang tidak memberi ruang umat memiliki penafsiran yang dapat dipertanggungjawabkan.
Abstrak : Sebuah istilah muncul kepermungkaan setelah berkembangnya Isu radikalisme dan terorisme yang sering dihubung-hubungkan dengan Umat Islam, yaitu moderat. Terjadi perdebatan ditengah-tengah kehidupan hari ini dalam memahami makna moderat tersebut, bagaiaman dan siapa yang dianggap sebagai muslim yang moderat atau berpaham moderat. This article aims to discuss the Hadast (excretion) and najis that are an obstacle for us to perform worship to Allah SWT. Repeating the study of taharah and najis in Islamic Fiqh will make us find a rule and discussion that we have never known before. It is necessary to Clean or clean first to worship to the maximum To get rid of the Hadast and unclean. Clean signals that we should always clean our souls from sin and all vile deeds. Clean is performed not only to achieve worship but also to maintain the cleanliness and health of the human body. We are required to know all the ins and outs of Clean and practice it correctly. There are still many Muslims who even do not understand Clean. The procedure of Clean has been mentioned in fiqh books in great detail. Always, with the method of content analysis and qualitative approach, the author tries to dig back into something that is rarely touched by fiqh books in general. In the reading of Pustaka, the author obtains the status of animal faeces that are halal eaten by the meat; it turns out that the wastes are not unclean according to various sects such as Malikyah and Hanabilah. So far, many people think that the faeces of chickens, goats, cows, and other livestock ate are unclean and can cancel Clean. Contemporary problems arise around Clean, such as a person whose body is full of tattoos and challenging to get rid of for the sake of his hifz An-Nafs Wudu 'remains if the tattoo can not be removed. Taharah has many other benefits, such as preventing Covid-19
Islam has a long history in Southern France and Italy and has contributed greatly to the formation of European civilization. This has been forgotten mainly by European and French people and Muslims in general. Driven by the Spirit of jihad and the spread of Islam, the Muslim soldiers have made France and Italy’s regions into an orderly administrative region that was previously filled up with injustice. A comparison of Arabic and Western literature, especially French and Spanish and Arabic literature, was conducted to complete this discussion. Arabic literature does not indicate in detail that Muslims have been in France for a long time based on physical evidence obtained in modern times. By conducting a literature study and a comparative historical, descriptive approach, it was found that Muslims suffered a crushing defeat in the battle with Charles Martel in Tours, October 10, 732. However, Muslims were still in Gaul, Bordeaux, and Anjou (Italy), and it took place for 250 years. This shows that Muslims could adapt to the local population.
