This research aimed to find out and analyze the legal protection of the parties in a food franchise agreement. Furthermore, this research also aimed to find out and analyze the efforts that could be taken by the parties in the event of default in the implementation of the Franchise Agreement. The research that made Sukoharjo Branch Bakso Tengkleng Mas Bambang Branch as a respondent was a juridical empirical qualitative research and analyzed the data collected using qualitative descriptive methods. The results of the research showed that the form of legal protection provided was in the form of preventive and repressive legal protection. Preventive legal protection could be seen in the clause contained in the Tengkleng Mas Bambang Meatball Franchise Agreement which contained the obligations of each party, namely in Articles 5 and 6 concerning the obligation to maintain confidentiality, maintain the brand, and comply with established procedures. Preventive legal protection was also stated in Article 1 number 9 and Article 11 of the Franchise Agreement regarding the prohibition to provide food and beverages other than Tengkleng Mas Bambang Meatballs and trade secrets. Repressive legal protection was seen through the provision of resolving disputes through consensus. If the meeting did not succeed in reaching an agreement then both parties could resolve the dispute through litigation. So far, any form of dispute that occured including defaults could still be resolved through deliberation without taking the path of litigation.
Penelitian kualitatif yang bersifat yuridis empiris ini dilaksanakan di Pengadilan Negeri (PN) Palembang dan Surabaya menunjukkan bahwa penerapan e-court secara umum dapat berkontribusi pada efisiensi peradilan. Kondisi ini terlihat pada seluruh pendaftaran perkara perdata yang melalui kuasa hukum di kedua PN sudah dilakukan melalui e-filing, begitu juga dengan taksiran dan pembayaran biaya perkara yang sudah menggunakan e-SKUM dan e-payment. Penggunaan e-summons dan e-litigation belum terlaksana dikarenakan pengguna peradilan masih enggan untuk menggunakan fitur tersebut. Hasil penelitian juga menunjukkan bahwa pengaturan mengenai e-summons menyimpangi ketentuan dalam HIR dan RBG terkait pemanggilan para pihak, namun kondisi ini dapat dimaklumi mengingat proses pembentukan undang-undang hukum acara perdata yang baru membutuhkan proses yang panjang sementara peningkatan efektifitas dan efisiensi peradilan dibutuhkan segera.
E-litigation or electronic-based trials is one of the features of e-court. This study seeks to provide answers regarding the extent to which the role of e-litigation in realizing the principle of contante justitie in the judiciary in Indonesia, especially in civil courts. This research also discusses what factors hinder the implementation of e-litigation in civil courts in Indonesia. The research that uses Yogyakarta District Court (PN) and Marabahan District Court (PN) as the object is qualitative research, which is juridical empirical and analyzes the collected data using qualitative descriptive methods.) The results showed that both the Yogyakarta District Court and the Marabahan District Court had e-litigation features available. Still, they had not fully contributed optimally in realizing the contante justitie principle in civil court. In the two PN's above, there are already several court users who use the e-litigation feature, especially regarding the submission of claims, answers, replicas, duplicates, conclusions, and written evidence electronically as reading the verdict electronically. However, for the electronic examination of witness and expert evidence, no court user has used it. The things that hinder the implementation of e-litigation in those district courts are court users' reluctance to use the e-litigation feature due to the unpractical regulation and the lack of internet availability signal access.
Kajian tentang bentuk perlindungan hukum terhadap Notaris yang melakukan tindak pidana pemalsuan Akta ini dilakukan dengan metode hukum yuridis normatif. Pendekatan yang digunakan adalah dengan menyelidiki hukum, konsep, dan kasus. Bahan hukum yang digunakan meliputi bahan hukum utama berupa undang-undang dan dokumen hukum lainnya yang berkaitan dengan tindak pidana pamalsuan Akta. Materi hukum sekunder yang berisi tentang Fungsi, Wewenang dan Sanksi tentang Jabatan Notaris dari perspektif peradilan pidana. Dan bahan hukum tersier. Analisis dilakukan pada tahap menafsirkan bahan hukum, mengevaluasi bahan hukum, dan mengevaluasi peraturan hukum yang terkait dengan masalah yang diselidiki. Temuan dan perkembangannya sebagai jawaban atas persoalan hukum mengenai perlindungan hukum terhadap Notaris yang melakukan tindak pidana pemalsuan akta Notaris, dan pertanggungjawaban pidana terhadap Notaris yang melakukan tindak pidana pemalsuan akta Notaris.
This normative juridical research using secondary data aims to explain how and what are the reasons underlying the changes in regulations related to filing objections to the Indonesia Competition Commission (KPPU) decision after the enactment of Law No. 11 of 2020 concerning Job Creation. These changes include changing the place for filing objections from the District Court to the Commercial Court and changing the period for examining objections from the previous maximum of 30 days to a minimum of 3 months and a maximum of 12 months. These changes are to improve the quality of decisions on filing objections to KPPU's decisions. It is hoped that giving authority to the Commercial Court will provide a higher quality decision because Judges at the Commercial Court are more familiar with economic law cases. In addition, the extended time for examination of objection legal efforts will provide flexibility for the Commercial Court Judges in examining cases. In conclusion, this condition is expected to contribute to realizing a healthy business climate and attracting investment to increase Indonesia's economic growth.
