Introduction: the issues of legal regulation of partner (Islamic) banking in Russia took on particular importance under the conditions of economic pressure put on Russia by a number of countries. The issue of attracting investment to the country, from the states of Asia and the Middle East in particular, has become especially essential nowadays. The development of partner banking in Russia is promoted by the fact that the population of Russia includes a significant number of Muslims, who are familiar with Shariah principles being fundamental for Islamic economy. Purpose: to analyze the essence and main features of the legal regulation of Islamic banking, the similarities and differences between the major approaches applied in Shariah principles and in Russian legislation, to identify problematic issues, and suggest possible ways of solving thereof. Methods: the present study is conducted based on a set of scientific methods, including analysis and synthesis, interdisciplinary approach and comparative legal studies. Results: the present paper demonstrates that the implementation of partner banking instruments is constrained by certain current prohibitions and restrictions in Russian legislation. Partner banking instruments are based on the fundamental principles of Shariah and theological doctrine, which in a number of cases do not fully correspond to, and sometimes conflict with, the legislation. The authors have considered the peculiarities of Islamic banking through the example of a Murabaha contract as the main institution of financing based on Shariah principles. The authors have concluded that in Russia there are various approaches to the issue of how to implement the instruments of Islamic banking in the Russian legal system, from zero tolerance to the need for an appropriate regulatory framework. Полномочия по вынесению решений об отказе в заключении договора банковского счета (вклада), по отказу в выполнении распоряжения о совершении банковской операции (далее-«отказные решения»), а также по расторжению договоров банковского счета (вклада) предоставлены кредитным организациям Федеральным законом от 07.08.2001 № 115-ФЗ. Неопределенность критериев для вынесения отказных решений и строгая ответственность за нарушение требований законодательства о ПОД/ФТ приводит к вынесению отказных решений в массовом порядке, обилию судебных споров о законности и обоснованности их вынесения, дестабилизирует рынок банковских услуг. В статье рассматриваются проблемы, связанные с реализацией отказных решений кредитными организациями, а также подвергается анализу новейший законопроект № 948530-7, направленный на совершенствование существующего правового регулирования по данному вопросу. Background/Objectives. The article is devoted to the principles of law governing the organization of judicial proceedings in international law. There are a number of principles of justice, such as the rule of law, the independence of judges, the reasonable period of proceedings, counterclaim, publicity, and others. This article covers not all, but some of them, which, in the authors' opinion, are the most publicly significant in the administration of justice. The most widely considered is the well-known principle of legality, which includes several aspects, including the prohibition of retroactive application of the law and the prohibition of the analogy of law. This article also emphasizes the importance of making a list of principles of justice. Methods. The main method of research is comparative analysis. Other scientific methods were also used in the study, such as: interdisciplinary synthesis, logical method, analogy method, specification, classification, and systematization. Conclusions. Among the general principles of law, there are some special provisions relating to justice. Such principles are applied in judicial proceedings at both the national and international levels of justice. A complete list of such principles has not yet been made. This study emphasizes the need to define and classify the principles of justice. In the context of the general nature of this study, it is understood that some of the issues raised in the article may be the subject of further research. In the absence of legal norms, the results of the study of the principles of justice applicable in international law could be very useful, especially for judges.
The sustainable Development agenda has long been a stable trend in the global economy. Russia has been included in this global theme for a long time. Legislation, regulations and recommendation documents were being developed in the country, special tools were being created, primarily in the banking sector. At the same time, the CODID-19 pandemic and the wave of sanctions pressure thatfollowed it raised the question of the expediency of further development of the ESG agenda in Russia. The article discusses the features of the legal regulation of ESG banking under the conditions of sanctions pressure. It is noted that the sustainable development agenda remains relevant in Russia, but is currently focused more on solving internal problems. The most important areas of ESG banking are: the development of universal terminology and a system of legal categories, taxonomy, ESG reporting, ratings, features of accounting for ESG factors in lending and financing procedures, as well as corporate governance and compliance control.Proposals are formulated to improve the regulatory and legal regulation of ESG banking in Russia.
