The object of the present study is the penitentiary legal relations associated with the participation of convicts in videoconferencing with the courts. A study is made of the practice of implementation in the activities of correctional institutions of measures related to the participation of convicts in video conferencing with the courts. An analysis is made of the provisions of regulatory legal acts regulating the withdrawal, escort and supervision of convicts participating in videoconferencing with the courts. A survey is conducted among employees of correctional institutions, whose activities are related to the organization of the participation of convicts in videoconferencing with the courts. Legal and organizational shortcomings associated with the withdrawal, escort and supervision of convicts participating in video conferencing are identified, and ways to eliminate them are proposed. The methodological basis of the study is a questionnaire survey, which involves receiving written answers to the questions formulated in the questionnaire from employees of correctional institutions of the Siberian Federal District in order to obtain real data on activities related to organizing the participation of convicts in videoconferencing with courts. This method made it possible to identify organizational problems associated with the withdrawal, support, organization and supervision of the convict during their participation in videoconferencing with the courts. As a result of the study, an algorithm is proposed for withdrawing, accompanying and supervising convicts participating in video conferencing.
One of the areas of effective legal regulation of penal legal relations is the compliance of lawmaking and law-enforcement activities with the requirements of the fundamental provisions of penal legislation. The object of the research is the implementation of the equality principle of convicts un-der the law through the consolidation of equal rights, duties and legitimate in-terests of convicts in the penal legislation. The subject of the research is the penal legislation norms governing the institution of the convicts’ departure outside the penitentiary. We indicate the connection of the phenomenon un-der study with the lawmaking and law-enforcement aspect of penal law. We outline some of the law-making and law-enforcement penal issues that are directly related to the consolidation and application of the penal legislation norms when granting convicts the right to leave the penitentiary to visit chil-dren. As a methodological basis for cognition, the following are used: general scientific methods of analysis, synthesis, induction, deduction, which make it possible to investigate aspects of penal legal reality directly related to the im-plementation of the principles of penal legislation, to formulate well-grounded conclusions; private scientific methods – formal legal and comparative legal – make it possible to identify problems of legal regulation, develop proposals for changing legislation. As a result of the study, we identify the penal legislation norms that contradict the equality principle of convicts under the law, and propose ways to eliminate the identified contradictions.
The object of the study is the implementation of equality principle before the law by fixing equal rights and obligations of prisoners in the normative legal acts of the Soviet state. The subject of research: provisions of normative legal acts of the Provisional Government, departmental normative acts of the People’s Commissariat of Justice of the RSFSR and People’s Commissariat for Internal Affairs of the RSFSR. As a methodological basis for cognition, general scientific methods of analysis, synthesis, induction, de-duction are used, which allow us to investigate aspects of legal reality directly related to the implementation of the principles of penal enforcement (correctional labor) legislation, to formulate reasonable conclusions. Private scientific methods: formal-legal and comparative-legal – allow us to identify differences in the legal regulation of the legal status of prisoners in the pre-war period. As a result of the conducted research, we make a reasonable conclusion that the principle of equality before the law, although it was not enshrined in specific norms regulating the procedure for the execution and serving of imprisonment, however, was manifested in the provisions regulating the legal status of persons deprived of liberty. The notions of equality before the law of both citizens in general and prisoners in particular were not the fundamental basis of the legislation of the Soviet State. Prisoners were differentiated on the basis of social affiliation, due to: 1) the principle of class approach proclaimed by the Constitution of the RSFSR; 2) the functioning of two systems of places of deprivation of liberty for prisoners with different social status; 3) regulating the execution (serving) of sentences in the form of deprivation of liberty by various regulatory legal acts.
В статье исследуются и сопоставляются признаки принципа равенства перед законом, закрепленного в Конституции РФ, уголовном и уголовно-исполнительном праве России. Проводится анализ доктринальных положений о диалектическом начале формального равенства и правовых исключений, заложенных в основу принципа равенства перед законом. Автором выявлены общие признаки, характеризующие исследуемый принцип как в качестве общеправового, так и в качестве отраслевого принципа. Исследуется судебная практика по вопросам реализации принципа равенства перед законом при назначении и исполнении уголовных наказаний. В результате проведенного исследования автором был сделаны обоснованные выводы: 1) о том, что уголовно-правовой и уголовно-исполнительный принцип равенства перед законом основан непосредственно на формальном равенстве и опосредован наличием правовых исключений, обусловленных действием отраслевых принципов справедливости и гуманизма; 2) о специфике реализации принципа равенства перед законом при назначении и исполнении уголовных наказаний. The article examines and compares the features of the principle of equality before the law, enshrined in the Constitution of the Russian Federation, criminal and penal law of Russia. The author analyzes the doctrinal provisions on the dialectical beginning of formal equality and legal exceptions laid down in the basis of the principle of equality before the law. The author has identified common features characterizing the principle under study, both as a general legal and as an industry principle. The article examines judicial practice on the implementation of the principle of equality before the law in the appointment and execution of criminal penalties. As a result of the conducted research, the author made reasonable conclusions: 1) that the criminal-legal and penal principle of equality before the law is based directly on formal equality and is mediated by the presence of legal exceptions due to the action of sectoral principles of justice and humanism; 2) on the specifics of the implementation of the principle of equality before the law in the appointment and execution of criminal penalties.
В статье проводится анализ уголовного и уголовно-исполнительного законодательства на предмет правового регулирования привлечения к ответственности осужденных к наказанию в виде лишения права заниматься определенной деятельностью за неисполнение требований приговора суда. Автором было выявлен пробел правового регулирования уголовно-исполнительных правоотношений, определяющий основания и порядок признания осужденных к наказанию в виде лишения права заниматься определенной деятельностью злостным нарушителем установленного порядка отбывания наказания. Обоснована необходимость закрепления в уголовно-исполнительном законодательстве норм, позволяющих работникам уголовно-исполнительных инспекций привлекать осужденных к наказанию в виде лишения права заниматься определенной деятельностью к дисциплинарной ответственности за уклонение от исполнения требования приговора суда. Автором предлагается закрепить в приказе Минюста России от 20.05.2009 № 142 «Об утверждении Инструкции по организации исполнения наказаний и мер уголовно-правового характера без изоляции от общества» порядок признания осужденных к лишению права занимать определенные должности или заниматься определенной деятельностью злостно уклоняющимися от исполнения, вступившего в законную силу, приговора суда и порядок незачета в срок отбывания наказания времени, в течение которого осужденный занимал запрещенную приговором суда должность или занимался запрещенной судом деятельностью. The article analyzes the Criminal and Penal enforcement legislation, for the purpose of legal regulation of bringing to justice convicted persons to punishment in the form of deprivation of the right to hold certain positions or engage in certain activities, for non-compliance with the requirements of the court verdict. The author has identified a gap in the legal regulation of criminal-executive legal relations, which determines the grounds and procedure for recognizing those sentenced to punishment in the form of deprivation of the right to hold certain positions or engage in certain activities, as a malicious violator of the established order of serving a sentence. The study justified the need to consolidate in the penal enforcement legislation the norms that allow employees of penal enforcement inspections to bring convicts to punishment in the form of deprivation of the right to engage in certain activities to disciplinary responsibility for evading the requirements of the court verdict. As a result of the conducted research, the author made reasonable conclusions: to fix in the Order of the Ministry of Justice of the Russian Federation dated May 20, 2009 No. 142 "On approval of the Instructions on the Organization of the Execution of punishments and measures of a criminal nature without isolation from society" the procedure for recognizing convicted persons to deprivation of the right of deprivation of the right to hold certain positions or engage in certain activities as maliciously evading the execution of a court sentence that has entered into legal force and the procedure for not setting off the time served during which the convicted person held a position prohibited by a court verdict or engaged in activities prohibited by the court.
